Hadith 6178

وَعَنْهَا مِنْ طَرِيقٍ ثَانٍ قَالَتْ كَانَتْ زَيْنَبُ تَفْلِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَعِنْدَهُ امْرَأَةُ عُثْمَانَ بْنِ مَعْظُونٍ وَنِسَاءٌ مِنَ الْمُهَاجِرَاتِ يَشْكُونَ مَنَازِلَهُنَّ وَأَنَّهُنَّ يُخْرَجْنَ مِنْهُ وَيُضَيَّقُ عَلَيْهِنَّ فِيهِ فَتَكَلَّمَتْ زَيْنَبُ وَتَرَكَتْ رَأْسَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنَّكِ لَسْتِ تَكَلَّمِينَ بِعَيْنَيْكِ تَكَلَّمِي وَاعْمَلِي عَمَلَكِ فَأَمَرَ رَسُولُ اللَّهِ يَوْمَئِذٍ أَنْ يُوَرَّثَ مِنَ الْمُهَاجِرِينَ النِّسَاءُ فَمَاتَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ فَوَرِثَتْهُ امْرَأَتُهُ دَارًا بِالْمَدِينَةِ
(Kulthum narrates:) Sayyida Zainab (may Allah be pleased with her) was removing lice from the Messenger of Allah (peace and blessings be upon him), and with him were the wife of Sayyiduna Uthman bin Maz'un (may Allah be pleased with him) and some emigrant women sitting. They were complaining about their homes, that (after the death of their husbands) they are expelled from their homes and hardship is imposed upon them. Sayyida Zainab (may Allah be pleased with her) also left the blessed head of the Prophet (peace and blessings be upon him) and began to talk, but the Prophet (peace and blessings be upon him) said to her: "You should not talk with your eyes; speak as well as do your work." (After hearing all these things) at that time the Messenger of Allah (peace and blessings be upon him) ordered that women should be made heirs of (their emigrant husbands). Thus, when Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) passed away, his wife became the heir of his house in Madinah.

Brief Explanation
Benefits: … The meaning of this hadith is that when a husband passes away, his heirs do not have the right to expel his wife from his house; rather, it is obligatory upon them to vacate the house for her. It appears that this ruling was specific to the Muhajirun (emigrants), and with their passing, this ruling also came to an end, and Allah knows best. Now, after the laws of inheritance have been established, the wife will be given her specific share. However, in this matter, as much ease as can be provided to her should be provided. For example, if her share is equal to the value of her husband's house, then she should be given the house. In any case, as much as possible, the wife's consent should be considered in the distribution of the estate.
