بَابُ مَا جَاءَ فِي الرَّجُلِ يُحْيِي الْأَرْضَ بِغَرْسِ شَجَرٍ أَوْ حَفْرِ بَيْر فَمَاذَا يَكُونُ حَرَمُهَا؟Chapter: What has been reported regarding a man who revives land by planting trees or digging a well—what is its protected area?

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ حَرِيمُ الْبِئْرِ أَرْبَعُونَ ذِرَاعًا مِنْ حَوَالَيْهَا كُلِّهَا لِأَعْطَانِ الْإِبِلِ وَالْغَنَمِ وَابْنُ السَّبِيلِ أَوَّلُ شَارِبٍ وَلَا يُمْنَعُ فَضْلُ مَاءٍ لِيُمْنَعَ بِهِ الْكَلَأُ
Narrated by Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: The enclosure of a well will be forty cubits from all sides; this space will be for camels and goats to sit. The first person to drink from such a well will be a traveler, and surplus water should not be withheld for the purpose of preventing others from using the grass through it.
Brief Explanation
Benefits: … When a person digs a well in dead (unused) land, then an area of forty by forty cubits around it will automatically become his enclosure; this space will be used for camels and goats to sit, and no other person will be able to use this enclosure for personal purposes.
This is a far-sighted and wise decision of the Noble Prophet sallallahu alayhi wa sallam.
“The traveler will be the first to drink”—its meaning is that among all those present, preference will be given to the traveler, and the owner of the well will have no right to prevent him.
The meaning of the last sentence is that if there is grass or similar fodder for animals to graze in a certain area, but there is only one spring or well or the water is limited, then people will only take their livestock to graze in that area when they have the right to use its water. If someone occupies that water with the intention that people should not bring their livestock to graze in that area at all, then the Prophet sallallahu alayhi wa sallam forbade such a person from doing so.
