Hadith 6131

عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ قَالَ قَالَ زَيْدُ بْنُ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ يَغْفِرُ اللَّهُ لِرَافِعِ بْنِ خَدِيجٍ أَنَا وَاللَّهِ أَعْلَمُ بِالْحَدِيثِ مِنْهُ إِنَّمَا أَتَى رَجُلَانِ قَدِ اقْتَتَلَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِنْ كَانَ هَذَا شَأْنَكُمْ فَلَا تُكْرُوا الْمَزَارِعَ قَالَ فَسَمِعَ رَافِعٌ قَوْلَهُ لَا تُكْرُوا الْمَزَارِعَ
It is narrated from Urwah bin Zubair that Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: May Allah forgive Sayyiduna Rafi' bin Khadij (may Allah be pleased with him), I know this blessed hadith better than him. The real matter was that when two men came to the Prophet (peace and blessings be upon him) and argued, the Prophet (peace and blessings be upon him) said: If this is your situation, then do not give lands on rent. Sayyiduna Rafi' (may Allah be pleased with him) only heard these words of the Prophet (peace and blessings be upon him): Do not give lands on rent.

Brief Explanation
Benefits: … From the style of the ahadith mentioned in this chapter, it is understood that, as a matter of expediency, renting out land has been prohibited. The summary of the blessed ahadith regarding renting out land, mentioned in the previous few chapters, is as follows: It is better that land should not be rented out; rather, it should be given to a Muslim brother to cultivate without any compensation. Renting out land in exchange for dirhams and dinars, i.e., cash payment, is permissible, as is practiced nowadays in the canal-irrigated areas of Pakistan. Renting out land for a specified portion of its total produce is permissible, as the Prophet sallallahu alayhi wa sallam did with the people of Khaybar; nowadays, this method is adopted in the rain-fed (barani) areas of Pakistan. It is prohibited to rent out land in such a way that certain parts of the land are specified for the owner and certain parts for the sharecropper (muzari‘), because in this there is a possibility of loss for one of the two parties.
