Hadith 6071

عَنْ عَمْرِو بْنِ الشَّرِيدِ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَيُّ الْوَاجِدِ ظُلْمٌ يُحِلُّ عِرْضَهُ وَعُقُوبَتَهُ قَالَ وَكِيعٌ عِرْضَهُ شَكَايَتَهُ وَعُقُوبَتَهُ حَبْسَهُ
Sayyiduna Shuraid (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: The delaying of a rich man is oppression; this act makes his honor and punishment lawful. Imam Waki’ said: By dishonor is meant to complain about him, and by punishment is meant to imprison him.

Brief Explanation
Benefits: … The restriction regarding a wealthy person indicates that a destitute person will be exempt from this ruling, and he will either be granted further respite or be pardoned.

The caliph and ruler have the right to imprison a person on the basis of suspicion or a crime, as is narrated from Sayyiduna Mu'awiyah bin Haydah radi Allahu anhu. He says: "Indeed, the Prophet sallallahu alayhi wa sallam imprisoned a man on suspicion." … The Noble Prophet sallallahu alayhi wa sallam imprisoned a man due to suspicion. (Abu Dawud: 3630, Tirmidhi: 1417, Nasa'i: 4875)
