عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ رَضِيَ اللَّهُ عَنْهُ قَالَ نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَنْ تُبَاعَ النَّخْلُ السَّنَتَيْنِ وَالثَّلَاثَ
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade selling the fruit of dates for two or three years.
Brief Explanation
Benefits: … Selling dates on their trees for more than one year in a single contract is called “Bay‘ Mu‘awamah.” The sale of the upper years refers to this very transaction. There is deception in this sale, because there is no knowledge of how much fruit will grow and what its quality will be, nor whether it will remain until the end or not.
