Brief Explanation
Benefits: … It is narrated from Sayyiduna Jabir bin Abdullah radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam said: “If you sell fruit to your brother and it is struck by a calamity, then it is not lawful for you to take anything from him. On what basis would you take anything from him? How would you take your brother’s wealth without right?” (Sahih Muslim) … “If you sell fruit to your brother and some calamity befalls it, then it is not lawful for you to take any price from it; on what basis would you take anything from him? How would you take your brother’s wealth without right?”
By “jawaih” (calamities) are meant those heavenly afflictions due to which all or some of the fruit is destroyed. The Noble Prophet sallallahu alayhi wa sallam has commanded in such a situation that the owner of the fruit or crop should return the price to the buyer. This is an extremely important issue, but generally landowners do not pay any attention to it, and in the case of such loss, they place the entire burden upon the buyer.
