Hadith 5825

عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ نَهَى أَنْ يَبِيعَ الرَّجُلُ فِحْلَةَ فَرَسِهِ
It is narrated from Sayyiduna Anas bin Malik, may Allah be pleased with him, that the Messenger of Allah, peace and blessings be upon him, forbade taking the price for the mating of a stallion.

Brief Explanation
Benefits: … From the last two ahadith, it is understood that the owner of a bull cannot take a fee for its mating.

It is narrated from Sayyiduna Anas bin Malik radi Allahu anhu that a man from Banu Kilab asked the Prophet sallallahu alayhi wa sallam about the mating of a bull. The Prophet sallallahu alayhi wa sallam forbade him from it. He said: When we give the bull for mating, we are given something as a mark of honor and respect. فَرَخَّصَ لَہُ فِیْ الْکَرَامَۃِ, so the Prophet sallallahu alayhi wa sallam permitted him regarding the honorarium. (Tirmidhi: 1274, Nasa’i: 7/310)

That is, the gift which is presented to the owner of the bull as a mark of honor and respect, without any condition, it is permissible for the owner to accept it. It is understood that here too the matter depends on intention; the owner of the bull should not intend to earn from it, rather his purpose should be to show kindness. If someone gives something, whether small or large in value, as an honorarium or out of respect, the owner may accept it, and if nothing is given, then the owner has no right to be displeased or to demand a fee. The owner must always distinguish between a wage and an honorarium, lest he begin to earn under the pretense of honorarium.
