Hadith 5823

عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا فِيمَا أَحْسِبُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الْمَاءِ
It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both), he says: I think that the Noble Prophet (peace and blessings be upon him and his family) forbade the selling of water.

Brief Explanation
Benefits: … A Muhajir Companion of the Messenger (sallallahu alayhi wa sallam) says: I participated in three battles with the Messenger of Allah (sallallahu alayhi wa sallam) and heard him say: “The Muslims are partners in three things: water, pasture, and fire.” (Abu Dawud: 3477, Ibn Majah: 2472) … “Muslims are partners in three things: water, fire, and grass (pasture).”

Sayyiduna Abu Hurairah (radi Allahu anhu) narrates that the Messenger of Allah (sallallahu alayhi wa sallam) said: “Three things are not to be withheld: water, pasture, and fire.” (Ibn Majah: 2473) … “Three things cannot be withheld (from others): water, grass (pasture), and fire.”

Muhammad ibn Isma’il al-San’ani, while discussing the prohibition of selling surplus water, said: From this hadith it is understood that selling water in excess of one’s need is prohibited. The scholars say: The situation is such that if a spring gushes forth in unowned land, the person whose land is closest to the spring is most entitled to its water, but once his land is irrigated, he no longer has any right to prevent others from using that water. Similarly, if a person digs a pit or a well in his own land and collects water, then after he has used the water for himself, his livestock, and his land, and there is still water left over, he cannot withhold it from others.
