Hadith 5353

عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا نَذْرَ لِابْنِ آدَمَ فِيمَا لَا يَمْلِكُ وَلَا عِتْقَ لِابْنِ آدَمَ فِيمَا لَا يَمْلِكُ وَلَا طَلَاقَ لَهُ فِيمَا لَا يَمْلِكُ وَلَا يَمِينَ فِيمَا لَا يَمْلِكُ
Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: The son of Adam has no vow in that which he does not own; the son of Adam has no emancipation in that which he does not own; he has no divorce in that which he does not own; and there is no oath in that which he does not own.
Brief Explanation
Benefits: … That is, it will not be obligatory to fulfill such an oath; however, according to the majority of scholars, one will have to offer the expiation (kaffarah) for breaking the oath.
