Hadith 5351

عَنْهُ مِنْ طَرِيقٍ ثَانٍ قَالَ وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَاللَّهِ لَاَنْ يَلَجَّ أَحَدُكُمْ بِيَمِينِهِ فِي أَهْلِهِ أَثَمُ لَهُ عِنْدَ اللَّهِ مِنْ أَنْ يُعْطِيَ كَفَّارَتَهُ الَّتِي فَرَضَ اللَّهُ عَزَّ وَجَلَّ
(Second chain) The Messenger of Allah, peace and blessings be upon him, said: By Allah! When a man swears an oath regarding his family’s matter and (persists in using that oath as an excuse), then he is more sinful in the sight of Allah Almighty than if he were to fulfill the expiation (kaffarah) made obligatory by Allah Almighty.

Brief Explanation
Benefits: Hafiz Ibn Hajar said: The meaning of "aatham" is "more sinful" (ashaddu ta'thiman)... The meaning and purport of this hadith is that if a person takes an oath (qasam) regarding matters related to his family, such that fulfilling it would cause them hardship, then he should break that oath and offer its expiation (kaffarah). If he says that he will not break the oath in order to avoid sin, then he will be sinful; rather, persisting in such an oath and causing hardship to his family is a greater sin than breaking the oath... Baydawi said: The intended meaning of this hadith is that when a person takes an oath regarding matters concerning his family and then persists upon it (without considering how much hardship it is causing his family due to this oath), then this sin is greater than the sin of breaking the oath, because he has made the name of Allah, the Exalted, a pretext for fulfilling his oath, whereas this has been prohibited.
