Hadith 5126

عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَيُّمَا قَرْيَةٍ أَتَيْتُمُوهَا فَأَقَمْتُمْ فِيهَا فَسَهْمُكُمْ فِيهَا وَأَيُّمَا قَرْيَةٍ عَصَتِ اللَّهَ وَرَسُولَهُ فَإِنَّ خُمُسَهَا لِلَّهِ وَرَسُولِهِ ثُمَّ هِيَ لَكُمْ
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him and his family) said: "When you enter a town and (after making a settlement with its people regarding wealth) stay there, then your share will be only that. But if the people of a town disobey Allah and His Messenger (and you fight them and gain victory, then their wealth will be considered spoils of war and) one-fifth of it will be for Allah and His Messenger, and the rest will all be yours."

Brief Explanation
Benefits: … The meaning of the first part of the blessed hadith is that whatever amount of wealth is agreed upon in reconciliation, that will be your right, and in the second part, there is mention of the spoils of war (mal-e-ghanīmah).
