عَنْ رُوَيْفِعِ بْنِ ثَابِتٍ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُ قَالَ قَامَ فِينَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَوْمَ حُنَيْنٍ فَقَالَ لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْقِيَ مَاءَهُ زَرْعَ غَيْرِهِ يَعْنِي إِتْيَانَ الْحُبَالَى مِنَ السَّبَايَا وَأَنْ يُصِيبَ امْرَأَةً ثَيِّبًا مِنَ السَّبْيِ حَتَّى يَسْتَبْرِئَهَا يَعْنِي إِذَا اشْتَرَاهَا وَأَنْ يَبِيعَ مَغْنَمًا حَتَّى يُقْسَمَ
It is narrated from Sayyiduna Ruwaifi’ bin Thabit Ansari (may Allah be pleased with him), he says: The Messenger of Allah (peace and blessings be upon him) stood among us on the day of Hunayn and said: It is not lawful for a man who believes in Allah and the Last Day to water someone else’s crop with his own water. By this, the Prophet (peace and blessings be upon him) meant that one should not have intimate relations with pregnant captive women. Also, the Prophet (peace and blessings be upon him) said: It is not lawful for a man to have intercourse with a captive woman who has a husband until she undergoes istibra’ of the womb, that is, when he buys such a woman, he should not have intimate relations with her before istibra’ of the womb. And it is also not lawful for a man to sell the spoils of war before they have been distributed.
