Hadith 5054

عَنْ عَوْفِ بْنِ مَالِكٍ الْأَشْجَعِيِّ وَخَالِدِ بْنِ الْوَلِيدِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَمْ يُخَمِّسِ السَّلْبَ
It is narrated from Sayyiduna Awf bin Malik Ashja'i and Sayyiduna Khalid bin Walid (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) did not take a fifth from the spoils (salb).

Brief Explanation
Benefits: … In this chapter, the ruling of spoils (salb) is discussed, the meaning of which is that the property taken from a slain disbeliever will be the right of the Muslim who killed him, and no khumus (one-fifth share) will be taken from this right. However, in such a case, the mujahid will be required to provide evidence that he actually carried out the killing.
