Hadith 4500

حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي أَبِي ثَنَا وَكِيعٌ ثَنَا سُفْيَانُ وَمِسْعَرٌ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنِ الْحَسَنِ الْعُرَنِيِّ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: قَدَّمَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أُغَيْلِمَةَ بَنِي عَبْدِ الْمُطَّلِبِ عَلَى حُمُرَاتٍ لَنَا مِنْ جَمْعٍ قَالَ سُفْيَانُ: بِلَيْلٍ فَجَعَلَ يَلْطَخُ أَفْخَاذَنَا وَيَقُولُ: ((أُبَيْنِيَّ لَا تَرْمُوا الْجَمْرَةَ حَتَّى تَطْلُعَ الشَّمْسُ)) وَزَادَ سُفْيَانُ: قَالَ ابْنُ عَبَّاسٍ: مَا إِخَالُ أَحَدًا يَعْقِلُ يَرْمِي حَتَّى تَطْلُعَ الشَّمْسُ
It is narrated from Sayyiduna Abdullah bin Abbas, may Allah be pleased with them both, that the Messenger of Allah, peace and blessings be upon him, sent the boys of Banu Abdul Muttalib from Muzdalifah at night, mounted on donkeys. In Sufyan’s narration, it is stated: The Messenger of Allah, peace and blessings be upon him, would pat our thighs and say: My dear sons! Do not throw pebbles at the Jamrah until the sun has risen. Sufyan said: Sayyiduna Abdullah bin Abbas, may Allah be pleased with them both, said: I do not think that any intelligent person would perform the Rami before sunrise.

Brief Explanation
Benefits: … In hadith number (4488), it has already been mentioned that the women had cast the pebbles before the dawn (Fajr) prayer, whereas in this hadith, the Prophet sallallahu alayhi wa sallam is commanding that stoning (rami) cannot be done before sunrise. There are only two possible ways to reconcile and harmonize these narrations: (1) The command of the Prophet sallallahu alayhi wa sallam is that those excused persons who leave Muzdalifah before the appointed time should perform rami only after sunrise, but the women who performed rami before Fajr did so based on their personal reasoning (ijtihad), and this is not far-fetched, because it is possible that the Prophet sallallahu alayhi wa sallam only granted them permission to leave Muzdalifah at night, but they deduced from this that upon reaching Mina, they could also perform rami, even if it was before sunrise, or even before Fajr. (2) Those women and men who are extremely elderly and severely excused, and cannot bear the crowd, may perform rami even before sunrise, while the rest of the generally excused people should cast the pebbles only after the sun has risen.

“Their personal reasoning (ijtihad)”: The real matter appears to be that those who performed rami before Fajr acted upon their own ijtihad. Furthermore, there is fundamentally no contradiction between a mawquf narration and a marfu‘ narration.
