Hadith 4193

(وَعَنْهُ مِنْ طَرِيقٍ ثَانٍ) قَالَ: كُنَّا نَسِيرُ مَعَ عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ فَإِذَا رَجُلٌ يُلَبِّي بِهِمَا جَمِيعًا، فَقَالَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ: مَنْ هَذَا؟ فَقَالُوا عَلِيٌّ فَقَالَ: أَلَمْ تَعْلَمْ أَنِّي نَهَيْتُ عَنْ هَذَا؟ قَالَ: بَلَى، وَلَكِنْ لَمْ أَكُنْ لِأَدَعَ قَوْلَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِقَوْلِكَ
(Second chain) Marwan says: We were going with Sayyiduna Uthman (may Allah be pleased with him) when a man was reciting the talbiyah for both Hajj and Umrah together. Sayyiduna Uthman (may Allah be pleased with him) asked: Who is this? People informed that it is Sayyiduna Ali (may Allah be pleased with him). So he said: Do you not know that I have prohibited this act? Sayyiduna Ali (may Allah be pleased with him) said: Yes, I certainly know, but I cannot abandon the saying of the Messenger of Allah (peace and blessings be upon him) on the basis of your statement.

Brief Explanation
Benefits: … We have already mentioned that the reason why some of the caliphs forbade performing ‘umrah along with Hajj was that they wanted people to undertake a separate journey for Hajj and a separate one for ‘umrah, so that they would become more deserving of reward and merit, as is evident from the next hadith. While they were aware that the Prophet sallallahu alayhi wa sallam had also commanded performing ‘umrah in this season, the wording of a narration in Sunan al-Nasa’i is as follows: When Sayyiduna ‘Uthman radi Allahu anhu forbade performing ‘umrah along with Hajj, Sayyiduna ‘Ali radi Allahu anhu and his companions recited the talbiyah for ‘umrah, but Sayyiduna ‘Uthman radi Allahu anhu did not prevent them. Then Sayyiduna ‘Ali radi Allahu anhu said to them: “Did you not hear the Messenger of Allah sallallahu alayhi wa sallam permitting this tamattu‘?” They replied: “Yes, indeed.”

The next hadith is even clearer in this matter, according to which Sayyiduna ‘Uthman radi Allahu anhu considered this ruling of his to be the result of his personal opinion—whoever wishes may adopt it, and whoever wishes may leave it.
