Hadith 4109

عَنْ عَمْرِو بْنِ دِينَارٍ ذَكَرُوا الرَّجُلَ يُهِلُّ بِعُمْرَةٍ فَيَحِلُّ، هَلْ لَهُ أَنْ يَأْتِيَ يَعْنِي امْرَأَتَهُ قَبْلَ أَنْ يَطُوفَ بَيْنَ الصَّفَا وَالْمَرْوَةِ، فَسَأَلْنَا جَابِرَ بْنَ عَبْدِ اللَّهِ، فَقَالَ: لَا حَتَّى يَطُوفَ بِالصَّفَا وَالْمَرْوَةِ، وَسَأَلْنَا ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا، فَقَالَ: قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَطَافَ بِالْبَيْتِ سَبْعًا فَصَلَّى خَلْفَ الْمَقَامِ رَكْعَتَيْنِ وَسَعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ، ثُمَّ قَالَ: {لَقَدْ كَانَ لَكُمْ فِي رَسُولِ اللَّهِ أُسْوَةٌ حَسَنَةٌ}
Amr bin Dinar says that people mentioned this matter: if a man puts on the ihram for Umrah, then he comes out of ihram, can he have intercourse with his wife before performing the Sa’i between Safa and Marwah? Then we asked Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) about this, and he said: No, he cannot do this until he has performed the Sa’i between Safa and Marwah. Then we asked Sayyiduna Ibn Umar (may Allah be pleased with him) this question, and he said: The Messenger of Allah (peace and blessings be upon him) came, performed seven circuits around the House of Allah, then offered two rak’ahs behind Maqam Ibrahim, and then performed the Sa’i between Safa and Marwah. After this, Sayyiduna Ibn Umar (may Allah be pleased with him) recited this verse: {لَقَدْ کَانَ لَکُمْ فِیْ رَسُوْلِ اللّٰہِ أَسْوَۃٌ حَسَنَۃٌ} … Indeed, in the life of the Messenger of Allah (peace and blessings be upon him) there is a best example for you. (Surah Al-Ahzab: 21)

Benefits: … Further hadiths regarding the ruling of ‘umrah:

(1) In the famous hadith of Jibril narrated by Sayyiduna ‘Umar radi Allahu anhu: When Jibril alayhis salam asked about Islam, the Prophet sallallahu alayhi wa sallam said: “Al-Islam is that you testify that there is no deity except Allah and that Muhammad is the Messenger of Allah, and that you establish the prayer, give zakat, perform pilgrimage (hajj) to the House and ‘umrah, perform ritual bath (ghusl) from major impurity (janabah), complete the ablution (wudu), and fast in Ramadan.” He (Jibril) said: “If I do that, am I a Muslim?” He (the Prophet) said: “Yes.” (Sahih Ibn Khuzaymah: 1/3)

(2) It is narrated from Sayyidah ‘A’ishah radi Allahu anha, she said: I asked, “O Messenger of Allah! Is jihad obligatory upon women?” He sallallahu alayhi wa sallam said: “Yes, there is jihad upon them, but there is no fighting in it, and it is hajj and ‘umrah.” (Sunan Ibn Majah: 2901) In another narration, the wording is: Sayyidah ‘A’ishah radi Allahu anha said: “O Messenger of Allah! Is jihad obligatory upon women?” He said: “Hajj and ‘umrah are the jihad of women.” In this hadith, the word “‘ala” clearly indicates obligation.

(3) Sabiy bin Ma‘bad said: “I saw hajj and ‘umrah as prescribed upon me, so I entered into ihram for both.” Sayyiduna ‘Umar radi Allahu anhu said to him: “You have been guided to the Sunnah of your Prophet.” (Sunan Abi Dawud: 1799) Sayyiduna ‘Umar ibn al-Khattab, Sayyiduna ‘Abdullah ibn ‘Abbas, Sayyiduna ‘Abdullah ibn ‘Umar, Sayyiduna Jabir, Imam al-Shafi‘i, Imam Ahmad, and others are of the opinion that ‘umrah is obligatory. Whereas Imam Abu Hanifah, Imam Malik, Imam al-Nakha‘i, and others hold that ‘umrah is not obligatory, but rather a Sunnah. ‘Allamah Shawkani says: The truth is that ‘umrah is not obligatory, and there is no explicit evidence for its obligation. However, the three proofs mentioned in the benefits indicate the obligation of ‘umrah.
