Hadith 4107

عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ: قَالَ عُرْوَةُ لِابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ حَتَّى مَتَى تُضِلُّ النَّاسَ يَا ابْنَ عَبَّاسٍ، قَالَ: مَا ذَاكَ يَا عُرْوَةُ؟ قَالَ: تَأْمُرُنَا بِالْعُمْرَةِ فِي أَشْهُرِ الْحَجِّ وَقَدْ نَهَى أَبُو بَكْرٍ وَعُمَرُ، فَقَالَ ابْنُ عَبَّاسٍ: قَدْ فَعَلَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ، فَقَالَ عُرْوَةُ: كَانَا هُمَا أَتْبَعَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَأَعْلَمَ بِهِ مِنْكَ
Urwah said to Sayyiduna Abdullah bin Abbas (may Allah be pleased with him): O Ibn Abbas! How long will you continue to mislead the people? He said: Urwah! What is the matter? He said: You permit people to perform Umrah during the months of Hajj, whereas Sayyiduna Abu Bakr (may Allah be pleased with him) and Sayyiduna Umar (may Allah be pleased with him) used to prohibit this. Sayyiduna Ibn Abbas (may Allah be pleased with him) said: This is an act that the Messenger of Allah (peace and blessings be upon him) himself performed. Urwah said: But both of them followed the Messenger of Allah (peace and blessings be upon him) more than you and had more knowledge about him.

Brief Explanation
Benefits: … Without any doubt, performing ‘umrah during the months of Hajj is permissible. From other narrations, it is understood that the reasoning before Sayyiduna Abu Bakr and Sayyiduna ‘Umar (radi Allahu anhuma) was that people should travel for Hajj during the months of Hajj, and then, in other months, come separately to perform ‘umrah, so that both acts of worship remain distinct in their own right, and so that separate effort and expenditure are borne for each. See ahadith numbers (4204, 4205, 4206). However, the opinion of the two Shaykhs does not mean that they considered performing ‘umrah during the months of Hajj to be impermissible. In hadith number (4194) and its commentary, this matter has been explained very beautifully; study it.
