عَنْ أَبِي قِلَابَةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَتَّابٍ قَالَ: كَانَ أَبُو هُرَيْرَةَ يَقُولُ: مَنْ أَصْبَحَ جُنُبًا فَلَا صَوْمَ لَهُ، قَالَ: فَأَرْسَلَنِي مَرْوَانُ بْنُ الْحَكَمِ أَنَا وَرَجُلًا آخَرَ إِلَى عَائِشَةَ وَأُمِّ سَلْمَةَ رَضِيَ اللَّهُ عَنْهُمَا نَسْأَلُهُمَا عَنِ الْجُنُبِ يُصْبِحُ فِي رَمَضَانَ قَبْلَ أَنْ يَغْتَسِلَ، قَالَ: فَقَالَتْ إِحْدَاهُمَا: قَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يُصْبِحُ جُنُبًا ثُمَّ يَغْتَسِلُ وَيُتِمُّ صِيَامَ يَوْمِهِ، وَقَالَتِ الْأُخْرَى: كَانَ يُصْبِحُ جُنُبًا مِنْ غَيْرِ أَنْ يَحْتَلِمَ ثُمَّ يُتِمُّ صَوْمَهُ، قَالَ: فَرَجَعَا فَأَخْبَرَا مَرْوَانَ بِذَلِكَ، فَقَالَ لِعَبْدِ الرَّحْمَنِ: أَخْبِرْ أَبَا هُرَيْرَةَ بِمَا قَالَتَا، فَقَالَ أَبُو هُرَيْرَةَ: كَذَا كُنْتُ أَحْسَبُ وَكَذَا كُنْتُ أَظُنُّ قَالَ: فَقَالَ لَهُ مَرْوَانُ: بِأَظُنُّ وَبِأَحْسَبُ تُفْتِي النَّاسَ
Abdur Rahman bin ‘Atab says: Sayyiduna Abu Hurairah (may Allah be pleased with him) used to say that whoever wakes up in a state of major ritual impurity (janabah), his fast is not valid. Marwan bin Hakam sent me and another man to Sayyidah Aisha (may Allah be pleased with her) and Sayyidah Umm Salamah (may Allah be pleased with her) so that we could ask them about the one who wakes up in a state of janabah before performing ghusl (ritual bath) during the month of Ramadan. One of them said: The Messenger of Allah (peace and blessings be upon him) would wake up in a state of janabah, but would then perform ghusl and complete the fast of that day. The other said: He (peace and blessings be upon him) would wake up in a state of janabah, but this janabah was not due to a wet dream, then he (peace and blessings be upon him) would complete his fast. Both of them returned and narrated this hadith to Marwan. Marwan said to Abdur Rahman: Inform Sayyiduna Abu Hurairah (may Allah be pleased with him) of the hadith of these two (Mothers of the Believers). Upon hearing this, Sayyiduna Abu Hurairah (may Allah be pleased with him) said: That was indeed my assumption, that was indeed my opinion. Marwan said to him: Do you give people religious verdicts based on assumption and personal opinion?
