Hadith 3522

عَنْ أَبِي رِمْثَةَ رَضِيَ اللَّهُ عَنْهُ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَالَ: ((يَدُ الْمُعْطِي الْعُلْيَا، أُمَّكَ وَأَبَاكَ وَأُخْتَكَ ثُمَّ أَدْنَاكَ))، فَقَالَ رَجُلٌ: يَا رَسُولَ اللَّهِ! هَؤُلَاءِ بَنُو يَرْبُوعٍ قَتَلَةُ فُلَانٍ، قَالَ: ((أَلَا لَا تَجْنِي نَفْسٌ عَلَى أُخْرَى))، وَقَالَ أَبِي: قَالَ أَبُو النَّضْرِ فِي حَدِيثِهِ: دَخَلْتُ الْمَسْجِدَ فَإِذَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَخْطُبُ وَيَقُولُ: ((يَدُ الْمُعْطِي الْعُلْيَا))
Narrated from Sayyiduna Abu Rumthah (may Allah be pleased with him), the Noble Prophet (peace and blessings be upon him) said: The hand of the giver is upper. Spend first on your mother, then your father, then your sister, then as the relatives become closer. A man said: O Messenger of Allah! These are the Banu Yarbu', they are the killers of such and such person. The Prophet (peace and blessings be upon him) said: No soul will commit a crime for another. Abu Nazr said in his narration: I entered the mosque while the Messenger of Allah (peace and blessings be upon him) was delivering a sermon, in which he also said: The hand of the giver is upper.

Brief Explanation
Benefits: … In the era of ignorance (Jahiliyyah), in order to exact retribution (qisas), they would kill any member of the murderer’s tribe instead of the actual killer. It seems that the questioner intended to refer to such a matter, which is why the Prophet sallallahu alayhi wa sallam refuted it, stating that every criminal is personally responsible for his own crime.

“The best charity (sadaqah) is that which is given after sufficiency (ghina, i.e., after fulfilling one’s personal needs),” and, “One should begin with those under one’s care.” These two statements do not refer to that self-imposed, extravagant lifestyle which has now become the standard for capitalists and those influenced by them. People’s temperaments have troubled them to such an extent that their household expenses amount to hundreds of thousands of rupees. Yet, according to the narration, they consider it sufficient to give four or five hundred or a thousand rupees in charity per month. If one observes the various acts of worship of the Noble Prophet sallallahu alayhi wa sallam, the greatest in quantity will be found to be charity and almsgiving.

Such people should consider it an honor to become the spiritual sons of Sayyiduna Uthman radi Allahu anhu, who purchased the well of Rumah for twenty thousand dirhams to provide drinking water to the poor Muslims of Madinah Munawwarah. This amounts to (5,240) tolas of silver.
