Hadith 339

عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ أَنَّ رَجُلًا أَوْصَى فِي مَسَاكِنَ لَهُ بِثُلُثِ كُلِّ مَسْكَنٍ لِإِنْسَانٍ، فَسَأَلْتُ الْقَاسِمَ بْنَ مُحَمَّدٍ فَقَالَ: اجْمَعْ ثَلَاثَةً فِي مَكَانٍ وَاحِدٍ، فَإِنِّي سَمِعْتُ عَائِشَةَ (رَضِيَ اللَّهُ عَنْهَا) تَقُولُ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((مَنْ عَمِلَ عَمَلًا لَيْسَ عَلَيْهِ أَمْرُنَا فَأَمْرُهُ رَدٌّ (وَفِي رِوَايَةٍ: فَهُوَ رَدٌّ)))
Sa’d bin Ibrahim (may Allah have mercy on him) says: A man made a will regarding his three houses that a third of each house should be given to a certain person. I asked Qasim bin Muhammad (may Allah have mercy on him) about this, and he said: “Allocate one house for the three individuals (and the remaining two houses for the heirs).” Indeed, I heard from Sayyidah Aisha (may Allah be pleased with her), she narrated that the Messenger of Allah (peace and blessings be upon him) said: “Whoever does an act upon which there is no command from us, then that act is rejected.”
