Hadith 2199

Aswad bin Yazid says: I asked Umm al-Mu'mineen Sayyida Aisha (may Allah be pleased with her): At what time do you perform Witr? She said: I do not perform Witr until the muezzins have given the calls to prayer, and they give these calls after the rising of Fajr. The Messenger of Allah (peace and blessings be upon him) had two muezzins: Sayyiduna Bilal (may Allah be pleased with him) and Sayyiduna Amr bin Umm Maktum (may Allah be pleased with him). The Messenger of Allah (peace and blessings be upon him) said: When Amr gives the call to prayer, you may eat and drink, because he is a blind man, but when Bilal gives the call to prayer, then stop eating and drinking, because Bilal does not give the call until the morning has arrived.

Brief Explanation
Benefits: … From this hadith, it is understood that the one who gave the first call to prayer (adhan) was Sayyiduna Amr ibn Umm Maktum radi Allahu anhu, and the one who gave the second adhan was Sayyiduna Bilal radi Allahu anhu. However, the order in the following hadith appears to be the opposite: Sayyidah Aisha radi Allahu anha narrates that the Noble Prophet sallallahu alayhi wa sallam said: “Indeed, Bilal gives the adhan at night, so continue eating and drinking (for suhur) until Ibn Umm Maktum gives the adhan.” (Bukhari: 622, 63; Muslim: 1092) The way to reconcile and harmonize these narrations is that the turns of these two mu’adhdhins would alternate; sometimes Bilal radi Allahu anhu would give the first adhan, and sometimes Sayyiduna Ibn Umm Maktum radi Allahu anhu would do so.

From the action of Sayyidah Aisha radi Allahu anha, it is evident that, without necessity, performing the witr prayer after the appearance of true dawn (tulu‘ al-fajr) is permissible. It is possible that what she meant was the first mu’adhdhin and the appearance of the false dawn (fajr kadhdhib), and it is also possible that sometimes, due to a legitimate (shar‘i) excuse, she would be delayed, and this action was mentioned here. (Wallahu a‘lam) In light of the marfu‘ ahadith, the clarification of this issue has already been given in the previous chapter, and several such ahadith have already been mentioned before, from which it is understood that the witr prayer should be performed before the appearance of true dawn.
