Hadith 1378

عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: كَانَ مَوْضِعُ مَسْجِدِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لِبَنِي النَّجَّارِ وَكَانَ فِيهِ نَخْلٌ وَخَرِبٌ وَقُبُورٌ مِنْ قُبُورِ الْجَاهِلِيَّةِ فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ: ((ثَامِنُونِي)) فَقَالُوا: لَا نَبْغِي بِهِ ثَمَنًا إِلَّا عِنْدَ اللَّهِ عَزَّ وَجَلَّ، فَأَمَرَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِالنَّخْلِ فَقُطِّعَ وَبِالْحَرْثِ فَأُفْسِدَ وَبِالْقُبُورِ فَنُبِشَتْ وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ قَبْلَ ذَلِكَ يُصَلِّي فِي مَرَابِضِ الْغَنَمِ حَيْثُ أَدْرَكَتْهُ الصَّلَاةُ
Sayyiduna Anas bin Malik (may Allah be pleased with him) says that the place of Masjid Nabawi was owned by Banu Najjar, and there were date palm trees and graves from the time of ignorance, and some part was deserted. The Messenger of Allah (peace and blessings be upon him) said to them: Make a deal with me for its price. But they said that we will take its price only from Allah Almighty. Then the Messenger of Allah (peace and blessings be upon him) ordered regarding the date palm trees, so they were cut down, and regarding the cultivation, so it was cleared, and regarding the graves, so they were dug up. Before this, wherever prayer time would find you, you would perform it there, even in the sheep pens.

Brief Explanation
Benefits: … In the narration of Sahih Bukhari, it is clarified that these were the graves of polytheist people. Since such graves possess no sanctity, they were exhumed and a mosque was constructed on that site. On one hand, the Prophet sallallahu alayhi wa sallam cursed those who build mosques over the graves of prophets and righteous people, and on the other hand, the very construction of Masjid Nabawi took place on the site of graves. Hafiz Ibn Hajar, while responding, says (meaning): The reason for the curse is that by doing so, veneration of the graves becomes necessary, then exaggeration in the status of the occupants of the graves begins, and the result of this is manifested in their worship. Similarly, exhuming the graves of prophets and their followers and constructing a mosque there for the sake of seeking blessings (tabarruk) also falls under the same category. As for the matter of the polytheists, there is no harm in exhuming their graves and dishonoring them, and constructing mosques on such sites does not necessitate their veneration, and it is precisely this veneration on account of which such an act has been prohibited.
