Hadith 12588

حَدَّثَنَا عَبْدُ اللَّهِ حَدَّثَنِي أَبِي ثَنَا الْوَلِيدُ الْأَوْزَاعِيُّ ثَنَا يَحْيَى عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ أَبِي وَأَبُو دَاوُدَ قَالَ حَدَّثَنَا حَرْبٌ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ قَالَ حَدَّثَنِي أَبُو سَلَمَةَ حَدَّثَنَا أَبُو هُرَيْرَةَ الْمَعْنَى قَالَ لَمَّا فَتَحَ اللَّهُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ مَكَّةَ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِيهِمْ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ ”إِنَّ اللَّهَ حَبَسَ عَنْ مَكَّةَ الْفِيلَ وَسَلَّطَ عَلَيْهَا رَسُولَهُ وَالْمُؤْمِنِينَ وَإِنَّمَا أُحِلَّتْ لِي سَاعَةً مِنَ النَّهَارِ ثُمَّ هِيَ حَرَامٌ إِلَى يَوْمِ الْقِيَامَةِ لَا يُعْضَدُ شَجَرُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا تَحِلُّ لُقْطَتُهَا إِلَّا لِمُنْشِدٍ وَمَنْ قُتِلَ لَهُ قَتِيلٌ فَهُوَ بِخَيْرِ النَّظَرَيْنِ إِمَّا أَنْ يَفْدِيَ وَإِمَّا أَنْ يَقْتُلَ“ فَقَامَ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ يُقَالُ لَهُ أَبُو شَاهٍ فَقَالَ يَا رَسُولَ اللَّهِ اكْتُبُوا لِي فَقَالَ ”اكْتُبُوا لَهُ“ فَقَالَ عَمُّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ إِلَّا الْإِذْخِرَ فَإِنَّهُ لِقُبُورِنَا وَبُيُوتِنَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ”إِلَّا الْإِذْخِرَ“ فَقُلْتُ لِلْأَوْزَاعِيِّ وَمَا قَوْلُهُ اكْتُبُوا لِأَبِي شَاهٍ وَمَا يَكْتُبُونَ لَهُ قَالَ يَقُولُ اكْتُبُوا لَهُ خُطْبَتَهُ الَّتِي سَمِعَهَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَيْسَ يُرْوَى فِي كِتَابَةِ الْحَدِيثِ شَيْءٌ أَصَحُّ مِنْ هَذَا الْحَدِيثِ لِأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ أَمَرَهُمْ قَالَ ”اكْتُبُوا لِأَبِي شَاهٍ“ مَا سَمِعَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ خُطْبَتَهُ
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that when Allah Almighty granted victory over Makkah to the Messenger of Allah (peace and blessings be upon him), the Messenger of Allah (peace and blessings be upon him) stood up and praised and glorified Allah Almighty, and then said: Allah Almighty had prevented the elephants from entering Makkah, and Allah has granted His Messenger and the believers authority over Makkah. For me, fighting in this city was permitted for a part of the day, but now it is a sanctuary (haram) until the Day of Resurrection. Its trees are not to be cut, its game is not to be frightened, and it is not permissible to pick up a lost item found here, except for one who will announce it. And if someone is killed here, his heir has the choice of one of two things: either to accept blood money or to have the killer executed.

A Yemeni man named Abu Shah stood up and said: O Messenger of Allah! Have these rulings written down for me. The Messenger of Allah (peace and blessings be upon him) said: Write it for Abu Shah.

Then your (peace and blessings be upon him) uncle, Sayyiduna Abbas (may Allah be pleased with him), requested permission to cut the idhkhir grass within the boundaries of the Haram, because it is commonly used for graves and houses. The Messenger of Allah (peace and blessings be upon him) said: Permission is granted to cut idhkhir.

Walid, the narrator, says: I asked Awza'i, what is meant by the statement of the Messenger of Allah (peace and blessings be upon him), "Write it for Abu Shah"? What did the Companions write for him? He said: The purpose was that the sermon which this man had heard should be written for him. Abu Abdur Rahman said: There is no hadith more authentic than this regarding the permissibility of writing hadith, because the Noble Prophet (peace and blessings be upon him) ordered that his sermon be written for Abu Shah.
