Hadith 11810

حَدَّثَنَا شُعْبَةُ سَمِعْتُ أَبَا إِسْحَاقَ سَمِعْتُ رَجُلًا مِنْ أَهْلِ نَجْرَانَ قَالَ سَأَلْتُ ابْنَ عُمَرَ قُلْتُ إِنَّمَا أَسْأَلُكَ عَنْ شَيْئَيْنِ عَنِ السَّلَمِ فِي النَّخْلِ وَعَنِ الزَّبِيبِ وَالتَّمْرِ فَقَالَ أُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِرَجُلٍ نَشْوَانَ (وَفِي لَفْظٍ سَكْرَانَ) قَدْ شَرِبَ زَبِيبًا وَتَمْرًا قَالَ فَجَلَدَهُ الْحَدَّ وَنَهَى أَنْ يُخْلَطَا قَالَ وَأَسْلَمَ رَجُلٌ فِي نَخْلِ رَجُلٍ فَلَمْ يَحْمِلْ نَخْلُهُ قَالَ فَأَتَاهُ يَطْلُبُهُ (فِي لَفْظٍ فَأَرَادَ أَنْ يَأْخُذَ دَرَاهِمَهُ) قَالَ فَأَبَى أَنْ يُعْطِيَهُ قَالَ فَأَتَيَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فَقَالَ ”أَحَمَلَتْ نَخْلُكَ“ قَالَ لَا قَالَ ”فَبِمَ تَأْكُلُ مَالَهُ“ قَالَ فَأَمَرَهُ فَرَدَّ عَلَيْهِ وَنَهَى عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ
It is narrated from Abu Ishaq, he says: I heard from a man of the people of Najran, he said: I asked Ibn Umar (may Allah be pleased with him) that I want to ask you about two issues, one is about the sale of dates in Salam (i.e., if a person makes a deal for dates with the owner before the crop is ready, is this permissible?), and the second question is about dried dates (munqā) and fresh dates. Abdullah bin Umar (may Allah be pleased with him) replied: A man was brought before the Messenger of Allah (peace and blessings be upon him) who was in a state of intoxication; he had drunk nabidh made from dried dates and fresh dates. The Prophet (peace and blessings be upon him) enforced the prescribed punishment on him and forbade making nabidh by mixing the two (because nabidh prepared by mixing both becomes intoxicating very quickly). And a man had made a Salam sale of dates with another; by chance, the date trees did not bear fruit. The owner came to the man to collect his agreed amount, but the other refused to pay. Both came to the Messenger of Allah (peace and blessings be upon him): The Prophet (peace and blessings be upon him) asked the owner: Did your date trees bear fruit? He said: No. The Prophet (peace and blessings be upon him) said: Then on what basis do you consume his wealth? And the Prophet (peace and blessings be upon him) forbade Salam sale until the fruit's quality becomes apparent.
