Hadith 11802

عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ قَالَ كَتَبَ نَجْدَةُ الْحَرُورِيُّ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ قَتْلِ الصِّبْيَانِ وَعَنِ الْخُمُسِ لِمَنْ هُوَ وَعَنِ الصَّبِيِّ مَتَى يَنْقَطِعُ عَنْهُ الْيُتْمُ وَعَنِ النِّسَاءِ هَلْ كَانَ يُخْرَجُ بِهِنَّ أَوْ يَحْضُرْنَ الْقِتَالَ وَعَنِ الْعَبْدِ هَلْ لَهُ فِي الْمَغْنَمِ نَصِيبٌ قَالَ فَكَتَبَ إِلَيْهِ ابْنُ عَبَّاسٍ أَمَّا الصِّبْيَانُ فَإِنْ كُنْتَ الْخَضِرَ تَعْرِفُ الْكَافِرَ مِنَ الْمُؤْمِنِ فَاقْتُلْهُمْ وَأَمَّا الْخُمُسُ فَكُنَّا نَقُولُ إِنَّهُ لَنَا فَزَعَمَ قَوْمُنَا أَنَّهُ لَيْسَ لَنَا وَأَمَّا النِّسَاءُ فَقَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ يَخْرُجُ مَعَهُ بِالنِّسَاءِ فَيُدَاوِينَ الْمَرْضَى وَيَقُمْنَ عَلَى الْجَرْحَى وَلَا يَحْضُرْنَ الْقِتَالَ وَأَمَّا الصَّبِيُّ فَيَنْقَطِعُ عَنْهُ الْيُتْمُ إِذَا احْتَلَمَ وَأَمَّا الْعَبْدُ فَلَيْسَ لَهُ مِنَ الْمَغْنَمِ نَصِيبٌ وَلَكِنَّهُ قَدْ كَانَ يُرْضَخُ لَهُمْ
It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) that Najdah Haruri wrote him a letter and asked him about these issues: What is the ruling on killing children? Who are the rightful recipients of khums? When does the designation of orphanhood end for a child? Can women participate in jihad or not? Does a slave have a share in the spoils of war or not? In reply, he wrote: If you are Khidr and you know that the child will grow up to be a disbeliever, then you can kill him. As for the issue of khums, we have always said that it is our right, that is, the right of Banu Hashim and Banu Muttalib, but now a group among us says that it is not our right. The Messenger of Allah (peace and blessings be upon him) used to take women with him in jihad; they would treat the sick and nurse the wounded, but they would not participate in fighting. When a child reaches puberty, the designation of orphanhood ends for him. A slave has no share in the spoils of war, but to encourage them, they would be given something as a gift.

Brief Explanation
Benefits: … “If you are Khidr.” By this is meant: if you are that Khidr whom Allah Ta’ala had informed about the outcome of that child, then you may kill those children. That is, you cannot kill them, because you do not have knowledge of their outcome.
