Hadith 11202

عَنْ بَهْزِ بْنِ حَكِيمِ بْنِ مُعَاوِيَةَ عَنْ أَبِيهِ عَنْ جَدِّهِ رَضِيَ اللَّهُ عَنْهُ قَالَ أَخَذَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ نَاسًا مِنْ قَوْمِي فِي تُهْمَةٍ فَحَبَسَهُمْ فَجَاءَ رَجُلٌ مِنْ قَوْمِي إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ وَهُوَ يَخْطُبُ فَقَالَ يَا مُحَمَّدُ عَلَامَ تَحْبِسُ جِيرَتِي فَصَمَتَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ عَنْهُ فَقَالَ إِنَّ نَاسًا لَيَقُولُونَ إِنَّكَ تَنْهَى عَنِ الشَّرِّ وَتَسْتَخْلِي بِهِ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ ”مَا يَقُولُ؟“ قَالَ فَجَعَلْتُ أُعَرِّضُ بَيْنَهُمَا بِالْكَلَامِ مَخَافَةَ أَنْ يَسْمَعَهَا فَيَدْعُوَ عَلَى قَوْمِي دَعْوَةً لَا يُفْلِحُونَ بَعْدَهَا أَبَدًا فَلَمْ يَزَلِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ بِهِ حَتَّى فَهِمَهَا فَقَالَ قَدْ قَالُوهَا أَوْ قَائِلُهَا مِنْهُمْ وَاللَّهِ لَوْ فَعَلْتُ لَكَانَ عَلَيَّ وَمَا كَانَ عَلَيْهِمْ خَلُّوا لَهُ عَنْ جِيرَانِهِ
It is narrated from Sayyiduna Muawiyah bin Haydah (may Allah be pleased with him), he says: The Noble Prophet (peace and blessings be upon him) had some people from our tribe arrested and imprisoned on the charge of accusation. Then a man from our tribe came to the Noble Prophet (peace and blessings be upon him) while he was delivering a sermon. He said: O Muhammad! Why have you imprisoned my neighbors? The Noble Prophet (peace and blessings be upon him) remained silent with him. He said again: People say that you forbid evil, while you are spreading evil. The Noble Prophet (peace and blessings be upon him) said: What is he saying? Sayyiduna Muawiyah says: I did not let the matter between the two become clear, fearing that perhaps the Noble Prophet (peace and blessings be upon him) might hear his words and curse my tribe, and then my tribe would never attain such-and-such. But the Noble Prophet (peace and blessings be upon him) kept engaging with him until he understood him. Then the Noble Prophet (peace and blessings be upon him) said: Did these people really say this accusatory thing? By Allah! If I do the act which I have forbidden, then its burden will be upon me. Release his neighbors.

Brief Explanation
Benefits: … From this hadith it is understood that it is permissible to detain the relevant individuals until the matter becomes clear. In reality, this is not a punishment, but rather for the purpose of investigation and inquiry into the crime. After this, it will be decided whether the individual in question is guilty or not, and whether his crime is liable for hadd or ta’zir punishment. Therefore, during this detention, no one should be subjected to hardship. See hadith number (6797).
