Hadith 10659

عَنْ جُبَيْرِ بْنِ مُطْعِمٍ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ لَا حِلْفَ فِي الْإِسْلَامِ وَأَيُّمَا حِلْفٍ كَانَ فِي الْجَاهِلِيَّةِ لَمْ يَزِدْهُ الْإِسْلَامُ إِلَّا شِدَّةً
It is narrated from Sayyiduna Jubair bin Mut’im (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: There is no mutual covenant in Islam, but any covenant or pact that was made in the pre-Islamic era of ignorance, Islam strengthens and reinforces it.

Brief Explanation
Benefits: … There are two types of covenants and agreements: (1) Those forms of covenants and agreements which are in opposition to Islamic teachings, for example, two individuals making an agreement between themselves that they will inherit from each other—this would affect the laws of inheritance established by Allah Ta'ala. Similarly, women making an agreement among themselves that they will collectively wail (perform niyahah) over each other's deceased, and so on. This type of covenant and agreement is prohibited in every circumstance; it makes no difference whether it was established before Islam or after.

(2) The type of covenant and agreement which supports the truth, such as maintaining ties of kinship (silat ar-rahm), supporting the truth, and helping the oppressed, etc. Such agreements are commendable in the view of the Shari'ah, and Islam further emphasizes them.

In these ahadith, these very two types have been mentioned: the first has been prohibited, and the second has been encouraged.
