بَابُ قِصَاصِ الْعَبْدِ
Chapter: Retaliation for the Slave
Hadith 181
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، وَقَبِيصَةُ، قَالاَ: حَدَّثَنَا سُفْيَانُ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ مَيْمُونِ بْنِ أَبِي شَبِيبٍ، عَنْ عَمَّارِ بْنِ يَاسِرٍ قَالَ: لاَ يَضْرِبُ أَحَدٌ عَبْدًا لَهُ وَهُوَ ظَالِمٌ لَهُ إِلاَّ أُقِيدَ مِنْهُ يَوْمَ الْقِيَامَةِ.
It is narrated from Sayyiduna Ammar bin Yasir (may Allah be pleased with both of them), he said: Whoever beats his slave unjustly, retribution will surely be taken from him on the Day of Resurrection.
Hadith 182
حَدَّثَنَا أَبُو عُمَرَ حَفْصُ بْنُ عُمَرَ، قَالَ: حَدَّثَنَا شُعْبَةُ قَالَ: حَدَّثَنِي أَبُو جَعْفَرٍ قَالَ: سَمِعْتُ أَبَا لَيْلَى قَالَ: خَرَجَ سَلْمَانُ فَإِذَا عَلَفُ دَابَّتِهِ يَتَسَاقَطُ مِنَ الْآرِيِّ، فَقَالَ لِخَادِمِهِ: لَوْلاَ أَنِّي أَخَافُ الْقِصَاصَ لَأَوْجَعْتُكَ.
It is narrated from Abu Laila (may Allah have mercy on him) that Salman went out (from his house) and saw that the fodder of his animals was falling from the place of fodder. He said to his servant: If I did not fear retribution (qisas) on the Day of Resurrection, I would certainly punish you.
Hadith 183
حَدَّثَنَا أَبُو الرَّبِيعِ، قَالَ: حَدَّثَنَا إِسْمَاعِيلُ، قَالَ: حَدَّثَنَا الْعَلاَءُ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: ”لَتُؤَدُّنَّ الْحُقُوقَ إِلَى أَهْلِهَا، حَتَّى يُقَادَ لِلشَّاةِ الْجَمَّاءِ مِنَ الشَّاةِ الْقَرْنَاءِ.“
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) said: "The rights of those entitled to rights will certainly be given to them, to the extent that the hornless goat will be recompensed for the harm done to it by the horned goat."
Hadith 184
حَدَّثَنَا عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْجُعْفِيُّ، قَالَ: حَدَّثَنَا أَبُو أُسَامَةَ قَالَ: حَدَّثَنِي دَاوُدُ بْنُ أَبِي عَبْدِ اللهِ مَوْلَى بَنِي هَاشِمٍ قَالَ: حَدَّثَنَي عَبْدُ الرَّحْمَنِ بْنُ مُحَمَّدٍ قَالَ: أَخْبَرَتْنِي جَدَّتِي، عَنْ أُمِّ سَلَمَةَ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ فِي بَيْتِهَا، فَدَعَا وَصِيفَةً لَهُ أَوْ لَهَا فَأَبْطَأَتْ، فَاسْتَبَانَ الْغَضَبُ فِي وَجْهِهِ، فَقَامَتْ أُمُّ سَلَمَةَ إِلَى الْحِجَابِ، فَوَجَدَتِ الْوَصِيفَةَ تَلْعَبُ، وَمَعَهُ سِوَاكٌ، فَقَالَ: ”لَوْلاَ خَشْيَةُ الْقَوَدِ يَوْمَ الْقِيَامَةِ، لَأَوْجَعْتُكِ بِهَذَا السِّوَاكِ.“ زَادَ مُحَمَّدُ بْنُ الْهَيْثَمِ: تَلْعَبُ بِبَهْمَةٍ. قَالَ: فَلَمَّا أَتَيْتُ بِهَا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قُلْتُ: يَا رَسُولَ اللَّهِ، إِنَّهَا لَتَحْلِفُ مَا سَمِعَتْكَ، قَالَتْ: وَفِي يَدِهِ سِوَاكٌ.
Narrated from Sayyida Umm Salama (may Allah be pleased with her) that the Prophet (peace and blessings of Allah be upon him) was in her house, and he called one of his or her young slave girls, but she delayed in responding to the command, which caused signs of anger to appear on the face of the Prophet (peace and blessings of Allah be upon him). Sayyida Umm Salama (may Allah be pleased with her) got up and went towards the curtain and saw that the slave girl was playing. The Prophet (peace and blessings of Allah be upon him) had a miswak in his hand. The Prophet (peace and blessings of Allah be upon him) said: "If I did not fear retribution and recompense on the Day of Resurrection, I would have beaten you with this miswak." Muhammad bin Haytham narrated with the addition of these words: "She was playing with an animal." The narrator says that Sayyida Umm Salama (may Allah be pleased with her) said: When I brought her to the Prophet (peace and blessings of Allah be upon him), I said: O Messenger of Allah! She is swearing that she did not hear your voice. She also said: The miswak was in your hand.
Hadith 185
حَدَّثَنَا مُحَمَّدُ بْنُ بِلاَلٍ، قَالَ: حَدَّثَنَا عِمْرَانُ، عَنْ قَتَادَةَ، عَنْ زُرَارَةَ بْنِ أَوْفَى، عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: ”مَنْ ضَرَبَ ضَرْبًا اقْتُصَّ مِنْهُ يَوْمَ الْقِيَامَةِ.“
It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever strikes someone, retribution will be taken from him on the Day of Resurrection."
Hadith 186
حَدَّثَنَا خَلِيفَةُ، قَالَ: حَدَّثَنَا عَبْدُ اللهِ بْنُ رَجَاءٍ، قَالَ: حَدَّثَنَا أَبُو الْعَوَّامِ، عَنْ قَتَادَةَ، عَنْ عَبْدِ اللهِ بْنِ شَقِيقٍ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: ”مَنْ ضَرَبَ ضَرْبًا ظُلْمًا اقْتُصَّ مِنْهُ يَوْمَ الْقِيَامَةِ.“
It is narrated from another chain from Abu Hurairah (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) said: "Whoever strikes someone unjustly, retribution will be taken from him on the Day of Resurrection."
