بَابُ مَنْ لَطَمَ عَبْدَهُ فَلْيُعْتِقْهُ مِنْ غَيْرِ إِيجَابٍ
Chapter: Whoever Slaps His Slave Should Free Him Without Obligation
Hadith 176
حَدَّثَنَا آدَمُ، قَالَ: حَدَّثَنَا شُعْبَةُ، قَالَ: حَدَّثَنَا حُصَيْنٌ قَالَ: سَمِعْتُ هِلاَلَ بْنَ يَسَافٍ يَقُولُ: كُنَّا نَبِيعُ الْبَزَّ فِي دَارِ سُوَيْدِ بْنِ مُقَرِّنٍ، فَخَرَجَتْ جَارِيَةٌ فَقَالَتْ لِرَجُلٍ شَيْئًا، فَلَطَمَهَا ذَلِكَ الرَّجُلُ، فَقَالَ لَهُ سُوَيْدُ بْنُ مُقَرِّنٍ: أَلَطَمْتَ وَجْهَهَا؟ لَقَدْ رَأَيْتُنِي سَابِعَ سَبْعَةٍ وَمَا لَنَا إِلاَّ خَادِمٌ، فَلَطَمَهَا بَعْضُنَا، فَأَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُعْتِقُهَا.
It is narrated from Bilal bin Yasaf (may Allah have mercy on him) that we were selling cloth in the house of Sayyiduna Suwaid bin Muqarrin (may Allah be pleased with him) when a slave girl came out and said something to a man, so the man slapped her. Upon this, Sayyiduna Suwaid bin Muqarrin (may Allah be pleased with him) said to him: "Did you slap her on the face? Indeed, I was the seventh among seven (brothers), and we had only one servant girl. When one of us slapped her, the Prophet (peace and blessings of Allah be upon him) ordered him to set her free."
Hadith 177
حَدَّثَنَا عَمْرُو بْنُ عَوْنٍ، وَمُسَدَّدٌ، قَالاَ: حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ فِرَاسٍ، عَنْ أَبِي صَالِحٍ، عَنْ زَاذَانَ، عَنِ ابْنِ عُمَرَ قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: ”مَنْ لَطَمَ عَبْدَهُ أَوْ ضَرَبَهُ حَدًّا لَمْ يَأْتِهِ، فَكَفَّارَتُهُ عِتْقُهُ.“
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that I heard the Noble Prophet (peace and blessings be upon him) say: "Whoever slaps his slave or beats him without fault, then its expiation is that he should set him free."
Hadith 178
حَدَّثَنَا مُسَدَّدٌ، قَالَ: حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ سُفْيَانَ قَالَ: حَدَّثَنِي سَلَمَةُ بْنُ كُهَيْلٍ قَالَ: حَدَّثَنِي مُعَاوِيَةُ بْنُ سُوَيْدِ بْنِ مُقَرِّنٍ قَالَ: لَطَمْتُ مَوْلًى لَنَا فَفَرَّ، فَدَعَانِي أَبِي فَقَالَ لَهُ: اقْتَصَّ، كُنَّا وَلَدَ مُقَرِّنٍ سَبْعَةً، لَنَا خَادِمٌ، فَلَطَمَهَا أَحَدُنَا، فَذُكِرَ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: ”مُرْهُمْ فَلْيُعْتِقُوهَا“، فَقِيلَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لَيْسَ لَهُمْ خَادِمٌ غَيْرَهَا، قَالَ: ”فَلْيَسْتَخْدِمُوهَا فَإِذَا اسْتَغْنَوْا خَلُّوا سَبِيلَهَا.“
It is narrated from Muawiyah bin Suwaid bin Muqrin (may Allah have mercy on him) that I slapped one of my slaves, so he ran away. My father called me and said, "Retribution will be taken from you." We were seven sons of Muqrin and had only one maidservant. One of our brothers slapped her, and this was mentioned before the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) said: "Order them to set her free." It was submitted to the Prophet (peace and blessings of Allah be upon him) that they have no other servant besides her. The Prophet (peace and blessings of Allah be upon him) said: "Let her serve them, and when they no longer need her, set her free."
Hadith 179
حَدَّثَنَا عَمْرُو بْنُ مَرْزُوقٍ، قَالَ: أَخْبَرَنَا شُعْبَةُ قَالَ لِي مُحَمَّدُ بْنُ الْمُنْكَدِرِ: مَا اسْمُكَ؟ فَقُلْتُ: شُعْبَةُ قَالَ: حَدَّثَنِي أَبُو شُعْبَةَ، عَنْ سُوَيْدِ بْنِ مُقَرِّنٍ الْمُزَنِيِّ، وَرَأَى رَجُلاً لَطَمَ غُلاَمَهُ، فَقَالَ: أَمَا عَلِمْتَ أَنَّ الصُّورَةَ مُحَرَّمَةٌ؟ رَأَيْتُنِي وَإِنِّي سَابِعُ سَبْعَةِ إِخْوَةٍ، عَلَى عَهْدِ رَسُولِ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، مَا لَنَا إِلاَّ خَادِمٌ، فَلَطَمَهُ أَحَدُنَا، فَأَمَرَنَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ نُعْتِقَهُ.
It is narrated from Sayyiduna Suwaid bin Muqarrin Al-Muzani (may Allah be pleased with him) that he saw a person who had slapped his slave, so he said: Do you not know that it is forbidden to strike the face? I saw during the time of the Messenger of Allah (peace and blessings be upon him) that we were seven brothers and had only one maidservant. If any one of us slapped her, the Prophet (peace and blessings be upon him) ordered us to set her free.
Hadith 180
حَدَّثَنَا مُوسَى، قَالَ: حَدَّثَنَا أَبُو عَوَانَةَ، قَالَ: حَدَّثَنَا فِرَاسٌ، عَنْ أَبِي صَالِحٍ، عَنْ زَاذَانَ أَبِي عُمَرَ قَالَ: كُنَّا عِنْدَ ابْنِ عُمَرَ، فَدَعَا بِغُلاَمٍ لَهُ كَانَ ضَرَبَهُ فَكَشَفَ عَنْ ظَهْرِهِ فَقَالَ: أَيُوجِعُكَ؟ قَالَ: لاَ. فَأَعْتَقَهُ، ثُمَّ رَفَعَ عُودًا مِنَ الأَرْضِ فَقَالَ: مَالِي فِيهِ مِنَ الأَجْرِ مَا يَزِنُ هَذَا الْعُودَ، فَقُلْتُ: يَا أَبَا عَبْدِ الرَّحْمَنِ، لِمَ تَقُولُ هَذَا؟ قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ أَوْ قَالَ: ”مَنْ ضَرَبَ مَمْلُوكَهُ حَدًّا لَمْ يَأْتِهِ، أَوْ لَطَمَ وَجْهَهُ، فَكَفَّارَتُهُ أَنْ يُعْتِقَهُ.“
Zadhan Abu Umar narrates that we were with Sayyiduna Ibn Umar (may Allah be pleased with them), so he called one of his slaves whom he had beaten. He removed the cloth from his back and asked, "Do you feel pain?" He replied, "No." So he set him free. Then he picked up a stick from the ground and said, "There is not even as much reward in this for me as the weight of this stick." I asked, "Abu Abdur Rahman! Why do you say this?" He said, "I heard the Prophet (peace and blessings of Allah be upon him) say: 'Whoever beats his slave without fault or slaps him, the expiation for that is to set him free.'"
