Hadith 417

حَدَّثَنَا أَبُو نُعَيْمٍ، قَالَ‏:‏ حَدَّثَنَا سُفْيَانُ، عَنْ أَيُّوبَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ‏:‏ ”لَيْسَ لَنَا مَثَلُ السَّوْءِ، الْعَائِدُ فِي هِبَتِهِ، كَالْكَلْبِ يَرْجِعُ فِي قَيْئِهِ‏.‏“
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings of Allah be upon him) said: "An evil example does not befit us (Muslims). The one who takes back a gift after giving it is like a dog that vomits and then licks it up itself."

Benefits and Issues:
➊ The point is that it does not befit a Muslim to be characterized by such bad manners that an evil example fits him. He should keep away from such actions. To give a gift and then take it back is to become like that dog which licks up its own vomit.
➋ From this, it is understood that to give a gift and then take it back or to demand its return is forbidden (haram). The Hanafi scholars’ declaring it permissible is in complete opposition to the hadith, and the reason for this is blind following of individuals (taqlid shakhsi). They reject the command of the Messenger (sallallahu alayhi wa sallam) by misinterpreting the hadith, but do not allow any harm to come to the position of their Imam. This is the marvel of taqlid and the distinguishing feature of the muqallidin!
➌ Parents may take back a gift given to their children, as is explicitly stated in some narrations.
