Hadith 124

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللهِ، قَالَ‏:‏ حَدَّثَنَا صَفْوَانُ بْنُ عِيسَى، قَالَ‏:‏ حَدَّثَنَا مُحَمَّدُ بْنُ عَجْلاَنَ، قَالَ‏:‏ حَدَّثَنَا أَبِي، عَنْ أَبِي هُرَيْرَةَ قَالَ‏:‏ قَالَ رَجُلٌ‏:‏ يَا رَسُولَ اللهِ، إِنَّ لِي جَارًا يُؤْذِينِي، فَقَالَ‏:‏ ”انْطَلِقْ فَأَخْرِجْ مَتَاعَكَ إِلَى الطَّرِيقِ“، فَانْطَلَقَ فَأَخْرِجَ مَتَاعَهُ، فَاجْتَمَعَ النَّاسُ عَلَيْهِ، فَقَالُوا‏:‏ مَا شَأْنُكَ‏؟‏ قَالَ‏:‏ لِي جَارٌ يُؤْذِينِي، فَذَكَرْتُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ‏:‏ ”انْطَلِقْ فَأَخْرِجْ مَتَاعَكَ إِلَى الطَّرِيقِ“، فَجَعَلُوا يَقُولُونَ‏:‏ اللَّهُمَّ الْعَنْهُ، اللَّهُمَّ أَخْزِهِ‏.‏ فَبَلَغَهُ، فَأَتَاهُ فَقَالَ‏:‏ ارْجِعْ إِلَى مَنْزِلِكَ، فَوَاللَّهِ لاَ أُؤْذِيكَ‏.‏
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that a man said: O Messenger of Allah! I have a neighbor who causes me harm. The Prophet (peace and blessings of Allah be upon him) said: "Go, take your belongings out (of your house) and place them on the road." He went and took his belongings out and placed them on the road. People came to him and asked: What happened to you? He said: My neighbor causes me trouble. I mentioned this to the Prophet (peace and blessings of Allah be upon him) and he instructed me: "Go, and take your belongings (out of your house) and place them on the road." (When people heard this) they said: May Allah curse him, may Allah disgrace him. When this reached the neighbor, he came to him and said: Return to your house, by Allah, I will never harm you again.

Benefits and Issues:
➊ It is permissible to backbite (ghibah) about an oppressor and to defame him so that people may hate him. Similarly, it is permissible to complain about him to the ruler of the time and to inform others about him.
➋ If a person does not care about the Shari’ah texts, then any effective method of protest can be adopted against him. It is permissible to raise one's voice against oppression and the oppressor, and to adopt any lawful means to be freed from him. From this, it is understood that if the government does not do justice, demonstrations can also be held against it. However, it is never permissible to destroy public property or to set vehicles on fire and spread destruction. The purpose of protest is to attain deliverance from oppression, not to spread anarchy in society.
➌ There should be a collective reaction against the oppressor so that he feels shame and embarrassment and refrains from his behavior.
➍ It is permissible to specifically curse (la’n) such an oppressor whose oppression is well-known. The meaning of la’n is to invoke Allah’s curse and distance from His mercy. If the curse is from Allah, it means that Allah has distanced him from His mercy, and what could be a greater deprivation than this? And the curse from the creation is to speak ill of him and to supplicate against him.
➎ One should help each other in acts of righteousness and piety (taqwa), and should discourage the oppressor and encourage the oppressed.
