Hadith 1194

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، قَالَ‏:‏ حَدَّثَنَا الْحَارِثُ بْنُ عُبَيْدٍ قَالَ‏:‏ حَدَّثَنِي أَبُو عِمْرَانَ، عَنْ زُهَيْرٍ، عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ‏: ”مَنْ بَاتَ عَلَى إِنْجَارٍ فَوَقَعَ مِنْهُ فَمَاتَ، بَرِئَتْ مِنْهُ الذِّمَّةُ، وَمَنْ رَكِبَ الْبَحْرَ حِينَ يَرْتَجُّ - يَعْنِي‏:‏ يَغْتَلِمُ - فَهَلَكَ بَرِئَتْ مِنْهُ الذِّمَّةُ‏.‏“
It is narrated from a companion of the Prophet (ﷺ) that the Prophet (ﷺ) said: "Whoever spends the night on an open roof and falls from it and dies, there is no liability for him. And whoever travels by sea during a storm and is destroyed, there is also no liability for him."

Benefits and Issues:
It is necessary to construct walls and curtains on the roof so that there is no risk of falling; otherwise, one should avoid sleeping on such a roof. Similarly, when the sea is in a state of turbulence during the white days (Ayyam al-Beedh) or for any other reason, one should avoid traveling in it.
