Hadith 1175

حَدَّثَنَا عَبْدُ اللهِ بْنُ صَالِحٍ قَالَ‏:‏ حَدَّثَنِي اللَّيْثُ قَالَ‏:‏ حَدَّثَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ قَالَ‏:‏ أَخْبَرَنِي عَامِرُ بْنُ سَعْدٍ، أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ قَالَ‏:‏ نَهَى رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ لِبْسَتَيْنِ وَبَيْعَتَيْنِ‏:‏ نَهَى عَنِ الْمُلاَمَسَةِ، وَالْمُنَابَذَةِ فِي الْبَيْعِ - الْمُلاَمَسَةُ‏:‏ أَنْ يَمَسَّ الرَّجُلُ ثَوْبَهُ، وَالْمُنَابَذَةُ‏:‏ يَنْبُذُ الْآخَرُ إِلَيْهِ ثَوْبَهُ - وَيَكُونُ ذَلِكَ بَيْعَهُمْ عَنْ غَيْرِ نَظَرٍ‏.‏ وَاللِّبْسَتَيْنِ اشْتِمَالُ الصَّمَّاءِ - وَالصَّمَّاءُ‏:‏ أَنْ يَجْعَلَ طَرَفَ ثَوْبِهِ عَلَى إِحْدَى عَاتِقَيْهِ، فَيَبْدُو أَحَدُ شِقَّيْهِ لَيْسَ عَلَيْهِ شَيْءٌ - وَاللِّبْسَةُ الأُخْرَى احْتِبَاؤُهُ بِثَوْبِهِ وَهُوَ جَالِسٌ، لَيْسَ عَلَى فَرْجِهِ مِنْهُ شَيْءٌ‏.‏
It is narrated from Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) forbade two types of clothing and two types of sales. In sales, he forbade mulamasa and munabadhah (mulamasa is when a person touches his garment, and munabadhah is when a person throws the garment towards another), and considering the sale to be complete merely by touching or throwing without seeing. And the two types of clothing that were forbidden are: samma’ (boli bakl); samma’ is when one edge of the garment is placed on one shoulder in such a way that there is nothing on the other shoulder. And the second type of clothing is to sit and wrap oneself with a garment in such a way that there is no separate cloth over the private parts.

Benefits and Issues:
➊ Mulaamasa is when a person sells a cloth or any other item in such a way that the buyer, without seeing it, merely touches it and the sale is finalized. Similarly, munaabadhah is when one throws an item towards another without either party having seen it, and the sale is finalized merely by the act of throwing. Both of these types of transactions are prohibited because the price is being determined in an unknown manner, which poses a risk of harm to either the buyer or the seller. There is an element of non-apparent dissatisfaction from either the buyer or the seller, which is not correct.

➋ Several meanings of "sammaa’" have been mentioned. One is that which is stated in the hadith: to take a cloth in such a way that one shoulder remains uncovered. Another meaning, which is more preponderant, is to take a single sheet in such a manner that the hands are enclosed within it; this is also called "boli bukl." Ihtibaa’ is when a person sits on his buttocks in such a way that both knees are upright and he ties his knees and back with a cloth, and if there is no other separate cloth covering the private parts, then there is a risk of exposure. Therefore, sitting in this manner is prohibited.
