حَدَّثَنَا
مُحَمَّدُ بْنُ عِيسَى ، حَدَّثَنَا
عَنْبَسَةُ بْنُ عَبْدِ الْوَاحِدِ ، عَنْ
هِشَامِ بْنِ عُرْوَةَ ، عَنْ
أَبِيهِ ، عَنْ
عَائِشَةَ ، قَالَتْ : " كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْتَنُّ وَعِنْدَهُ رَجُلَانِ ، أَحَدُهُمَا أَكْبَرُ مِنَ الْآخَرِ ، فَأَوْحَى اللَّهُ إِلَيْهِ فِي فَضْلِ السِّوَاكِ أَنْ كَبِّرْ أَعْطِ السِّوَاكَ أَكْبَرَهُمَا " ، قَالَ أَحْمَدُ هُوَ ابْنُ حَزْمٍ : قَالَ لَنَا أَبُو سَعِيدٍ هُوَ ابْنُ الْأَعْرَابِيِّ ، هَذَا مِمَّا تَفَرَّدَ بِهِ أَهْلُ الْمَدِينَةِ .
Narrated Aishah, Ummul Muminin: The Messenger of Allah ﷺ was using the tooth-stick, when two men, one older than the other, were with him. A revelation came to him about the merit of using the tooth-stick. He was asked to show proper respect and give it to the elder of the two.

Benefits and Issues:
➊ It is understood that when something is to be given to someone, preference should be given to the elder, provided that they are not seated in order. If they are seated in order, then the right-hand side person's right will take precedence, even if he is younger. Similarly, in conversation and while walking, the elder should be given priority.
➋ If someone gives his used miswak (tooth-stick) to another, there is no harm in using it, and it is obvious that it will be used after being washed. However, those who are enamored with modern civilization find this repugnant, and this is evidence of their unfamiliarity with the Shari‘ah.
