Hadith 47

حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى ، أَخْبَرَنَا عِيسَى بْنُ يُونُسَ ، حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ ، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ التَّيْمِيِّ ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ : " لَوْلَا أَنْ أَشُقَّ عَلَى أُمَّتِي ، لَأَمَرْتُهُمْ بِالسِّوَاكِ عِنْدَ كُلِّ صَلَاةٍ " ، قَالَ أَبُو سَلَمَةَ : فَرَأَيْتُ زَيْدًا يَجْلِسُ فِي الْمَسْجِدِ وَإِنَّ السِّوَاكَ مِنْ أُذُنِهِ مَوْضِعَ الْقَلَمِ مِنْ أُذُنِ الْكَاتِبِ ، فَكُلَّمَا قَامَ إِلَى الصَّلَاةِ اسْتَاكَ .
Narrated Zayd ibn Khalid al-Juhani: I heard the Messenger of Allah ﷺ say: Were it not hard on my ummah, I would order them to use the tooth-stick at the time of every prayer. Abu Salamah said: Zayd ibn Khalid used to attend the prayers in the mosque with his tooth-stick on his ear where a clerk carries a pen, and whenever he got up for prayer he used it.

Benefits and Issues:
➊ The title of the Messenger of Allah sallallahu alayhi wa sallam is "Mercy to the worlds" (rahmatu lil-'alamin). Thus, considering the hardship for the ummah, he sallallahu alayhi wa sallam did not give a formal command to use the tooth-stick (miswak) with every prayer. Had he commanded it, it would have become obligatory, and the commands of the Messenger of Allah sallallahu alayhi wa sallam are obligatory to follow.
➋ It is certainly more virtuous to delay the 'Isha prayer, but if the congregation is being held early, it is not permitted to leave it.
➌ The eagerness of Zayd radi Allahu anhu to follow (the Sunnah) is extremely commendable.

English Commentary:
1:
Using the miswak is Sunnah at the time of every prayer.
The phrase ((‘inda kulli salatin)) “at the time of every prayer” means that the objective is fulfilled by using the miswak upon entering the mosque,
at the place of ablution,
or by using the miswak along with ablution (wudu) at the time of prayer.
The people of India and Pakistan generally use the miswak from neem or keekar (acacia) trees, while in Arab lands, the miswak from the peelu tree is used extensively.
And here, people frequently use the miswak at the time of prayer.
