Hadith 4516

حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى ، حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ ، حَدَّثَنِي أَبِي ، عَنْ قَتَادَةَ ، بِإِسْنَادِهِ مِثْلَهُ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : مَنْ خَصَى عَبْدَهُ خَصَيْنَاهُ ، ثُمَّ ذَكَرَ مِثْلَ حَدِيثِ شُعْبَةَ ، وَحَمَّادٍ ، قَالَ أَبُو دَاوُد : وَرَوَاهُ أَبُو دَاوُدَ الطَّيَالِسِيُّ ، عَنْ هِشَامٍ ، مِثْلَ حَدِيثِ مُعَاذٍ .
Narrated Qatadah: Through the same chain of narrators as mentioned before, i. e. Samurah reported the Messenger of Allah ﷺ as saying: If anyone castrates his slave, we shall castrate him. He then mentioned the rest of the tradition like that of Sh'ubah and Hammad. Abu Dawud said: Abu Dawud al-Tayalisi transmitted it from Hisham like the tradition of Muadh.

Benefits and Issues:
According to some Imams, both of the aforementioned narrations are weak; therefore, the later narrations are authentic, and the ruling is as established from them: that the owner will not be killed in retribution (qisas) for the slave.
However, for those who consider the aforementioned narrations to be authentic (sahih) or good (hasan), their view is that the meaning is only for deterrence, admonition, and warning, not for actually carrying out retribution (qisas), or else these narrations are abrogated.
