Hadith 450

حَدَّثَنَا رَجَاءُ بْنُ الْمُرَجَّى ، حَدَّثَنَا أَبُو هَمَّامٍ الدَّلَّالُ مُحَمَّدُ بْنُ مُحَبَّبٍ ، حَدَّثَنَا سَعِيدُ بْنُ السَّائِبِ ، عَنْ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ عِيَاضٍ ، عَنْ عُثْمَانَ بْنِ أَبِي الْعَاصِ ، " أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَهُ أَنْ يَجْعَلَ مَسْجِدَ الطَّائِفِ حَيْثُ كَانَ طَوَاغِيتُهُمْ " .
Narrated Uthman ibn Abul As: The Prophet ﷺ commanded him to build a mosque at Taif where the idols were placed.

450. Commentary:
This narration is weak in its chain of transmission, but the matter stated within it is correct according to other evidences. This mosque in Ta’if was also constructed at the very place where the idol-house and shrine of the idol Lāt stood. The left minaret of this mosque was situated at the location of that idol-house. It is thus evident that, under Islamic governance, it is permissible to convert the places of worship of disbelievers into mosques, especially in the case when a country is conquered. And it is historically established that Emperor Alamgir also had mosques constructed in India upon the sites of the places of worship of disbelievers. [عون المعبود]

Commentary:
This narration is weak in its chain of transmission, but the matter stated within it is correct according to other evidences.
The mosque in Ta’if was also constructed at the very place where the idol temple and shrine of al-Lat stood.
It is thus evident that, under Islamic governance, it is permissible to convert the places of worship of disbelievers into mosques, especially in the case when a land is conquered.
Furthermore, it is historically established that Emperor Alamgir also had mosques constructed upon the places of worship of disbelievers in India. See: ‘Awn al-Ma‘bud.
