Hadith 4492

حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ ، حَدَّثَنَا ابْنُ وَهْبٍ ، أَخْبَرَنِي عَمْرٌو ، أَنَّ بُكَيْرَ بْنَ الْأَشَجّ حَدَّثَهُ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، قَالَ : حَدَّثَنِي عَبْدُ الرَّحْمَنِ بْنُ جَابِرٍ ، أَنَّ أَبَاهُ حَدَّثَهُ ، أَنَّهُ سَمِعَ أَبَا بُرْدَةَ الْأَنْصَارِيَّ ، يَقُولُ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ ، فَذَكَرَ مَعْنَاهُ .
The tradition mentioned above has also been transmitted by Abu Burdah al-Ansari through a different chain of narrators. This version has: I heard the Messenger of Allah ﷺ say. . . He then mentioned the tradition to the same effect.

Benefits and Issues:
Imam Ibn Qayyim rahimahullah states that in this hadith, the “limits of Allah” (hudud Allah) refers to those commands and prohibitions that pertain to etiquette, just as a father disciplines his child.
Imam Malik, Abu Yusuf, and Abu Thawr rahimahumullah, among others, say that discretionary punishment (ta’zir) is according to the nature of the crime, and it depends on how much the offender can bear.
And in this matter, the primary consideration is the welfare (maslahah), therefore, it is permissible to strike more than the prescribed amount of the well-known limits.
