Hadith 4490

حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ ، حَدَّثَنَا صَدَقَةُ يَعْنِي ابْنَ خَالِدٍ ، حَدَّثَنَا الشُّعَيْثِيُّ ، عَنْ زُفَرَ بْنِ وَثِيمَةَ ، عَنْ حَكِيمِ بْنِ حِزَامٍ ، أَنَّهُ قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُسْتَقَادَ فِي الْمَسْجِدِ ، وَأَنْ تُنْشَدَ فِيهِ الْأَشْعَارُ ، وَأَنْ تُقَامَ فِيهِ الْحُدُودُ " .
Narrated Hakim ibn Hizam: The Messenger of Allah ﷺ forbade to take retaliation in the mosque, to recite verses in it and to inflict the prescribed punishments in it.

Benefits and Issues:
➊ This narration is weak in its chain of transmission, but due to other supporting evidences, it reaches the level of hasan (acceptable). The details of these supporting evidences have been clarified by our esteemed researcher in the referencing and authentication section. In addition, Shaykh al-Albani rahimahullah has also graded it as hasan.

➋ Mosques are built for the purpose that prayers (salah) are performed in them, the recitation of the Qur’an takes place, and the remembrance (dhikr) of Allah is made. Although retribution (qisas) or prescribed punishments (hudud) are matters of the Shari‘ah, they do not maintain the sanctity of the mosque. Similarly, reciting frivolous and indecent poetry is also impermissible. However, poetry that contains praise of Allah, eulogy of the Messenger of Allah (sallallahu alayhi wa sallam), and themes based on Shari‘ah may be recited and listened to.
