Hadith 4461

Narrated Salamah ibn al-Muhabbaq: A similar tradition (to the No. 4445) has also been transmitted by Salamah ibn al-Muhabbaq from the Prophet ﷺ. This version has: If she asked her to have intercourse with her voluntarily, then she and a similar slave-girl would be given to her mistress from his property.

Explanation & Benefits
Shaykh Umar Farooq Saeedi
Benefits and Issues:
The statements of the Companions (radi Allahu anhum) differ regarding adultery with a slave woman owned by one’s wife.
Shaykh Shawkani (rahimahullah) has given preference to the ruling of Sayyiduna Nu’man ibn Bashir (radi Allahu anhu).
And the reason for this is that, due to the husband’s authority over the property of his wife, there exists a certain doubt (shubha); therefore, the punishment of stoning (rajm) should not be carried out.
And Allah knows best.
