Hadith 4375

حَدَّثَنَا جَعْفَرُ بْنُ مُسَافِرٍ ، وَمُحَمَّدُ بْنُ سُلَيْمَانَ الْأَنْبَارِيُّ ، قَالَا : أَخْبَرَنَا ابْنُ أَبِي فُدَيْكٍ ، عَنْ عَبْدِ الْمَلِكِ بْنِ زَيْدٍ نَسَبَهُ جَعْفَرٌ إِلَى سَعِيدِ بْنِ زَيْدِ بْنِ عَمْرِو بْنِ نُفَيْلٍ ، عَنْ مُحَمَّدِ بْنِ أَبِي بَكْرٍ ، عَنْ عَمْرَةَ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ إِلَّا الْحُدُودَ " .
Narrated Aishah, Ummul Muminin: The Messenger of Allah ﷺ Said: Forgive the people of good qualities their slips, but not faults to which prescribed penalties apply.

Benefits and Issues:
The prescribed legal punishments (hudud) of the Shariah, without exception, apply to both the general public and the elite.
For lesser offenses, if they occur out of negligence or for the first time, and the judge (qadi) or administrators feel that a verbal warning is sufficient, then it is better to pardon them. However, if someone is a habitual offender or it is perceived from his case that he feels no shame for his action, then punishment should be administered.
