Hadith 4372

حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ ، حَدَّثَنَا عَلِيُّ بْنُ حُسَيْنٍ ، عَنْ أَبِيهِ ، عَنْ يَزِيدَ النَّحْوِيِّ ، عَنْ عِكْرِمَةَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ وَيَسْعَوْنَ فِي الأَرْضِ فَسَادًا أَنْ يُقَتَّلُوا أَوْ يُصَلَّبُوا أَوْ تُقَطَّعَ أَيْدِيهِمْ وَأَرْجُلُهُمْ مِنْ خِلافٍ أَوْ يُنْفَوْا مِنَ الأَرْضِ إِلَى قَوْلِهِ غَفُورٌ رَحِيمٌ سورة المائدة آية 33 ـ 34 نَزَلَتْ هَذِهِ الْآيَةُ فِي الْمُشْرِكِينَ ، فَمَنْ تَابَ مِنْهُمْ قَبْلَ أَنْ يُقْدَرَ عَلَيْهِ لَمْ يَمْنَعْهُ ذَلِكَ أَنْ يُقَامَ فِيهِ الْحَدُّ الَّذِي أَصَابَهُ " .
Narrated Abdullah ibn Abbas: The verse "The punishment of those who wage war against Allah and His Messenger, and strive with might and main for mischief through the land is execution, or crucifixion, or the cutting off of hands and feet from opposite side or exile from the land. . . most merciful" was revealed about polytheists. If any of them repents before they are arrested, it does not prevent from inflicting on him the prescribed punishment which he deserves.

Brief Explanation
1؎ : In Sunan al-Nasa'i, the wording here is as follows: «فمن تاب منهم قبل أن يقدر عليه لم يكن عليه سبيل، وليست هذه الآية للرجل المسلم، فمن قتل وأفسد في الأرض وحارب الله ورسوله ثم لحق بالكفار قبل أن يقدر عليه لم يمنعه ذلك أن يقام فيه الحد الذي أصابه».

2؎ : This is solely the opinion of Ibn Abbas (radi Allahu anhuma); the majority of scholars hold a contrary view. Furthermore, there is criticism regarding its narrator, Ali ibn Husayn—his memory was weak, and thus he was prone to error.

Benefits and Issues:

It is established from other authentic ahadith that this noble verse was revealed concerning the people of ‘Ukl and ‘Uraynah, and the well-known jurisprudential principle is that, in rulings, the generality of the wording is considered, not the specific reasons for revelation.


If a criminal repents before being apprehended, it is hoped that the rights of Allah will be forgiven, but the rights of the servants (‘ibad) are not forgiven. See: (al-Rawdah al-Nadiyyah: 2/620, etc.)
