Hadith 3673

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ ثَابِتٍ ، عَنْ أَنَسٍ ، قَالَ : " كُنْتُ سَاقِيَ الْقَوْمِ حَيْثُ حُرِّمَتِ الْخَمْرُ فِي مَنْزِلِ أَبِي طَلْحَةَ ، وَمَا شَرَابُنَا يَوْمَئِذٍ إِلَّا الْفَضِيخُ ، فَدَخَلَ عَلَيْنَا رَجُلٌ ، فَقَالَ : إِنَّ الْخَمْرَ قَدْ حُرِّمَتْ ، وَنَادَى مُنَادِي رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقُلْنَا : هَذَا مُنَادِي رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " .
Narrated Anas ibn Malik: I was serving wine to the people in the house of Abu Talhah when it was prohibited and that day our wine was made from unripe dates. A man entered upon us and said: The wine has been prohibited, and the herald of the Messenger of Allah ﷺ made an announcement. We then said: This is the herald of the Messenger of Allah ﷺ

Benefit: It appears that the wine for which the final ruling of prohibition was revealed was not made from grapes. Rather, it used to be made from unripe dates.

Hadith Commentary:
The meaning of the chapter is derived from the words of the hadith "it was poured out in the streets of Madinah."
It is understood from this that the land of the pathways is common property for all people, but it is permissible to pour out things like wine there, provided that it does not cause harm to those who pass by.
The scholars have stated that it is prohibited to pour so much water in the pathway that it causes difficulty for passersby, so to throw impurities and the like there is even more strictly prohibited.
Abu Talhah (radi Allahu anhu) gave the order to pour out the wine in the pathway so that the general public would become aware of the prohibition of wine.

Wine was poured out in the pathway so that its abandonment would be publicly announced among the people.
Its benefit was greater than its harm, therefore this course of action was chosen.
If the ground is hard or the path is narrow, then pouring out wine or water, etc., should be avoided so that people are not harmed and their feet do not slip.
The point is that since the pathway is shared, such actions are not considered oppression or transgression, but the condition is that passersby are not harmed by it, and this is possible when the ground absorbs such liquids and no foul odor spreads from it.
People of refined nature avoid throwing impurities and foul-smelling things in the street or alley; similarly, a drum or basket, etc., should be used for garbage.

The judge’s verdict cannot make the unlawful lawful. This is the position of the majority of scholars. The Hanafis restrict this narration to matters of wealth. In their view, it is as if contracts—such as sale, marriage (nikah), divorce (talaq), etc.—would become void by the judge’s verdict, but this is without evidence. For contracts, the consent of both parties is necessary, not the judge’s verdict (see also Hadith: 5403).

Benefit:
This hadith proves that it is permissible to obtain the service of another person, and whenever the noble Companions (radi Allahu anhum) received a command from the Prophet (sallallahu alayhi wa sallam), they would act upon it immediately. These very people were the embodiment of the verse: ﴿وَمَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانتَهُوا[59-الحشر:7].
