Hadith 3562

حَدَّثَنَا الْحَسَنُ بْنُ مُحَمَّدٍ ، وَسَلَمَةُ بْنُ شَبِيب ، قَالَا : حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، حَدَّثَنَا شَرِيكٌ ، عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ ، عَنْ أُمَيَّةَ بْنِ صَفْوَانَ بْنِ أُمَيَّةَ ، عَنْ أَبِيهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " اسْتَعَارَ مِنْهُ أَدْرَاعًا يَوْمَ حُنَيْنٍ ، فَقَالَ : أَغَصْبٌ يَا مُحَمَّدُ ، فَقَالَ : لَا ، بَلْ عَارِيَةٌ مَضْمُونَةٌ " ، قَالَ أَبُو دَاوُد : وَهَذِهِ رِوَايَةُ يَزِيدَ ، بِبَغْدَادَ ، وَفِي رِوَايَتِهِ بِوَاسِطٍ تَغَيُّرٌ عَلَى غَيْرِ هَذَا .
Narrated Safwan ibn Umayyah: The Messenger of Allah ﷺ borrowed coats of mail from him on the day of (the battle of) Hunayn. He asked: Are you taking them by force. Muhammad? He replied: No, it is a loan with a guarantee of their return. Abu Dawud said: This tradition narrated by Yazid (b. Harun) at Baghdad. There is some change in the tradition narrated by him at Wasit, which is something different.

«أخرجه أبوداود، البيوع، باب في تضمين العارية، حديث:3562، والحاكم:2 /47 وصححه، ووافقه الذهبي. وحديث ابن عباس أخرجه الحاكم وصححه علي شرط مسلم، ووافقه الذهبي وإسناده حسن، إسحاق بن عبدالواحد وثقه الجمهور فحديثه لا ينزل عن درجة الحسن.«وفيه قال صفوان: يا رسول الله »»©Explanation:
➊ The aforementioned narration has been declared weak in its chain by our esteemed researcher, whereas other scholars have deemed it authentic and have discussed it in detail, from which the opinion of the authenticity of the hadith appears to be closer to correctness.
Therefore, despite the aforementioned narration being weak in its chain, it is actionable due to other supporting evidences and corroborations.

➋ When the Noble Prophet (sallallahu alayhi wa sallam) borrowed armors from Safwan (radi Allahu anhu) on the occasion of the Battle of Hunayn, at that time he was a non-Muslim. Therefore, from this hadith it is understood that it is permissible to borrow something even from a non-Muslim.

➌ It is also necessary to return an item borrowed on guarantee.
If it is lost for some reason, its value must be paid.

➍ If the borrower intentionally destroys or wastes the borrowed item, then according to everyone, its value must be paid.

© Hadith Narrator:
«حضرت صفوان بن امیہ رضی اللہ عنہ » By this is meant Safwan bin Umayyah bin Khalaf bin Wahb al-Qurashi al-Jumahi, who was a resident of Makkah.
He was among the “Mu’allafatu al-Qulub” (those whose hearts were to be reconciled) from among the Companions and was counted among the nobles of Quraysh.
He fled on the day of the Conquest of Makkah.
When protection was sought for him, he returned, and later participated with the Prophet (sallallahu alayhi wa sallam) in the Battle of Hunayn, but at that time he was in a state of disbelief.
Later, he entered the fold of Islam and demonstrated excellent Islam.
He passed away during the days when ‘Uthman (radi Allahu anhu) was martyred by the rebels.
