حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ، حَدَّثَنَا هَمَّامٌ ، عَنْ قَتَادَةَ ، عَنِ النَّضْرِ بْنِ أَنَسٍ ، عَنْ بَشِيرِ بْنِ نَهِيكٍ ، عَنِ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " الْعُمْرَى جَائِزَةٌ " .
Narrated Abu Hurairah: The Prophet ﷺ as saying: Life tenancy is permissible.
Brief Explanation
1؎: «عمرى» is itself a type of gift (hibah); in this, the one making the gift gives the thing being gifted to the recipient for the entirety of the recipient’s lifetime.

Benefit: In this hadith, the meaning of (ja’izah) is (past and continuous), that is, after death, the heirs of the one to whom the gift (hibah) was given will inherit it.
