Hadith 3253

حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ ، حَدَّثَنَا زُهَيْرٌ ، حَدَّثَنَا الْوَلِيدُ بْنُ ثَعْلَبَةَ الطَّائِيُّ ، عَنِ ابْنِ بُرَيْدَةَ ، عَنْ أَبِيهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ حَلَفَ بِالْأَمَانَةِ ، فَلَيْسَ مِنَّا " .
Narrated Buraydah ibn al-Hasib: The Prophet ﷺ said: He who swears by Amanah (faithfulness) is not one of our number.

Brief Explanation
1؎: Because an oath should be sworn by the names and attributes of Allah, and "amanat" (trust) is not among His names or attributes; rather, it is one of His commands. Therefore, swearing an oath by "amanat" will be considered a permissible act, and there will be no expiation (kaffarah) for it. According to Imam Abu Hanifah, swearing an oath by "amanat" is valid, and expiation (kaffarah) will be obligatory for it, because "Amin" (the Trustworthy) is a name of Allah.

Benefits and Issues:
Iman (faith) or amanah (trust) are matters obligated by Allah.
There is no meaning in swearing an oath by them; therefore, it is impermissible.
However, according to Imam Shafi‘i rahimahullah, there is no expiation (kaffarah) for this.
