Hadith 3165

حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ ، أَخْبَرَنَا سُفْيَانُ ، عَنِ الْأَسْوَدِ بْنِ قَيْسٍ ، عَنْ نُبَيْحٍ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ، قَالَ : كُنَّا حَمَلْنَا الْقَتْلَى يَوْمَ أُحُدٍ لِنَدْفِنَهُمْ ، فَجَاءَ مُنَادِي النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " يَأْمُرُكُمْ أَنْ تَدْفِنُوا الْقَتْلَى فِي مَضَاجِعِهِمْ ، فَرَدَدْنَاهُمْ " .
Narrated Jabir ibn Abdullah: On the day of Uhud we brought the martyrs to bury them (at another place), but the crier of the Prophet ﷺ came and said: The Messenger of Allah ﷺ has commanded you to bury the martyrs at the place where they fell. So we took them back.

Benefits and Issues:
After burying the deceased, it is disliked (makruh) to transfer them from there without any significant Shari'ah-based necessity.
(Sunan Abi Dawud, Funerals, No: 32329) However, before burial, it is permissible to transfer them.
And especially, martyrs (shuhada) should be buried at the very place where they were martyred; this is superior.

(1) The explanation of this ruling has already been stated under Hadith number 2005.
(2) In the Battle of Uhud, the respected father of Jabir radi Allahu anhu, Abdullah radi Allahu anhu, was also martyred; therefore, Jabir radi Allahu anhu had a special connection to this command.
(3) The Messenger of Allah sallallahu alayhi wa sallam received information that some people had taken the bodies of their close martyrs to Madinah, as is mentioned in Hadith 2006, and there was also the possibility of more bodies being taken; therefore, he issued this command.

Explanation:
1:
This ruling is specific to the martyrs (shuhada).
The wisdom mentioned is that these martyrs remain together in death and life, as well as in resurrection and gathering (ba‘th wa hashr).
For an ordinary deceased person, there is no harm in transferring the body from one place to another in case of extreme necessity.
The condition is that the corpse must not be disrespected, and there should be no change in it due to the effects of water or air.
Sa‘id ibn Abi Waqqas was transferred to Madinah in the presence of the Companions (radi Allahu anhum),
and no one objected to this.

(Based on corroborating narrations and supporting witnesses, this hadith is authentic; otherwise, its narrator Nabih ‘Anazi is considered weak in hadith.)

Without a specific necessity, it is not appropriate to transport the deceased from one city to another for burial.
