Hadith 3088

حَدَّثَنَا يَحْيَى بْنُ مَعِينٍ حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ حَدَّثَنَا أَبِي سَمِعْتُ مُحَمَّدَ بْنَ إِسْحَقَ يُحَدِّثُ عَنْ إِسْمَعِيلَ بْنِ أُمَيَّةَ عَنْ بُجَيْرِ بْنِ أَبِي بُجَيْرٍ قَالَ سَمِعْتُ عَبْدَ اللَّهِ بْنَ عَمْرٍو يَقُولُ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ حِينَ خَرَجْنَا مَعَهُ إِلَى الطَّائِفِ فَمَرَرْنَا بِقَبْرٍ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ هَذَا قَبْرُ أَبِي رِغَالٍ وَكَانَ بِهَذَا الْحَرَمِ يَدْفَعُ عَنْهُ فَلَمَّا خَرَجَ أَصَابَتْهُ النِّقْمَةُ الَّتِي أَصَابَتْ قَوْمَهُ بِهَذَا الْمَكَانِ فَدُفِنَ فِيهِ وَآيَةُ ذَلِكَ أَنَّهُ دُفِنَ مَعَهُ غُصْنٌ مِنْ ذَهَبٍ إِنْ أَنْتُمْ نَبَشْتُمْ عَنْهُ أَصَبْتُمُوهُ مَعَهُ فَابْتَدَرَهُ النَّاسُ فَاسْتَخْرَجُوا الْغُصْنَ .
Narrated Abdullah ibn Amr ibn al-As: When we went out along with the Messenger of Allah ﷺ to at-Taif we passed a grave. I heard the Messenger of Allah ﷺ say: This is the grave of Abu Righal. He was in this sacred mosque (sanctuary) protecting himself (from punishment). When he came out, he suffered the same punishment which his people suffered at this place, and he was buried in it. The sign of it is that a golden bough was buried with him. If you dig it out, you will find it with him. The people hastened to it and took out the bough.

Benefits and Issues:
Undoubtedly, this narration is weak in its chain of transmission.
But the ruling remains that if someone takes out such wealth from the graves of disbelievers, it will be considered as rikaz (buried treasure).
Because honoring the graves of disbelievers is not obligatory in the same way as it is for the graves of Muslims.
Therefore, their graves will be treated as ordinary land,
from which a buried treasure may be obtained by excavation.
