Narrated Asmar ibn Mudarris: I came to the Prophet ﷺ, and took the oath of allegiance to him. He said: If anyone reaches a water which has not been approached before by any Muslim, it belongs to him. The people, therefore, went out running and marking (on the land).

Benefits and Issues:
This narration is weak in its chain of transmission.
However, in light of other authentic ahadith, the cultivation and settlement of barren and uninhabited lands is permitted equally for everyone, except if the ruler of the time allocates a particular area for someone specifically.
As will be mentioned in the next chapter.
This is contrary to those springs, wells, or ponds which are located on public thoroughfares.
