Hadith 2920

حَدَّثَنَا حُسَيْنُ بْنُ مُعَاذٍ ، حَدَّثَنَا عَبْدُ الأَعْلَى ، حَدَّثَنَا مُحَمَّدٌ يَعْنِي ابْنَ إِسْحَاق ، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " إِذَا اسْتَهَلَّ الْمَوْلُودُ وُرِّثَ " .
Narrated Abu Hurairah: The Prophet ﷺ said: When an infant has raised its voice (and then dies), it will be treated as an heir.

When it is established that a newborn was alive—by breathing, moving, sneezing, crying, etc.—then, according to the Shariah, he will be entitled to inheritance.

«أخرجه أبوداود، الفرائض، باب في المولود يستهل ثم يموت، حديث:2920، وابن حبان (الإحسان):7 /609، حديث:6000.* ابن إسحاق عنعن وله شواهد ضعيفة.»©Explanation:
Our esteemed researcher has declared the mentioned narration to be weak in its chain of transmission (isnad), whereas other scholars have deemed it authentic, and their opinion appears to be correct. Therefore, despite the mentioned narration being weak in its chain, due to other supporting evidences and corroborating narrations, it is acceptable for practice and as proof.
